A PROCLAMATION.

IN pursuance and exercise of the powers conferred by section twelve of the Land Act, 1924, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby proclaim as closed the street in New Brighton Borough described in the Schedule hereto.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 24th day of May, 1938.

Land set apart as an Addition to a Public School Site.

A PROCLAMATION.

IN pursuance and exercise of the powers conferred by subsection nine of section twelve of the Land Act, 1924, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that from and after the date hereof the land comprised in the piece of closed road described in the First Schedule hereto, being an area adjacent to the reserve for a public school site (Petane), described in the Second Schedule hereto, shall be deemed to be added to the said reserve.

SECTION 10R, Block XII, Puketapu Survey District: Area, 1 rood 24·2 perches.

SECOND SCHEDULE.

HAWKE’S BAY LAND DISTRICT.

ALL that area in the Hawke’s Bay Land District containing by admeasurement 5 acres 0 roods 5 perches, more or less, being Lot 1, Block 70, Western Side of Harbour, Block XII, Puketapu Survey District, bounded towards the north-east by Sections 9R and 10R, Block XII, Puketapu Survey District, for a distance of 1424·3 links; towards the south-east by Section 23, Block XII, Puketapu Survey District, 328·0 links; towards the south-west by a public road, 1072·4 links; towards the west and north-west by a public road, 886·1 links; be all the aforesaid linkages more or less: As the same are delineated on the plan marked L. and S. 16/1840E, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 24th day of May, 1938.

Portion of Bannister Street, in the Borough of Masterton, exempted from the Provisions of Section 128 of the Public Works Act, 1928.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 1st day of June, 1938.

Present :

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Masterton Borough Council, on the twenty-second day of March, one thousand nine hundred and thirty-eight, viz. :—

“The Masterton Borough Council, being the local authority having control of the streets within the Borough of Masterton, by resolution declares, that in pursuance of section one hundred and twenty-eight of the Public Works Act, 1928, we take the necessary steps to exempt from street widening the Bannister Street frontage of the land on D.P. 8356, being part Section 5, Town of Masterton, Block I, Otahoua Survey District ”;

the portion of street affected by such resolution being described in the Schedule hereto.

SCHEDULE.

THE north-eastern side of all that portion of street, situated in the Wellington Land District, Borough of Masterton, known as Bannister Street, fronting Lot 1, D.P. 8356, and being part Section 5, Town of Masterton. As the same is more particularly delineated on the plan marked P.W.D. 99108, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Exempting Crown Land from certain Provisions of the Mining Act, 1926.

GALWAY, Governor-General.

IN pursuance and exercise of the powers conferred upon me by section twenty of the Mining Act, 1926, and of every other power and authority enabling me in this behalf, I, George Vere Arundell, Viscount Galway, do hereby exempt the Crown land particularly described in the Second Schedule hereto from the provisions of those sections of the Mining Act, 1926, mentioned in the First Schedule hereto, subject to existing registered mining privileges, and do also hereby declare that such exemption shall take effect from the date of the publication of this notice in the New Zealand Gazette.

SECTIONS 144 to 152 (both inclusive).

SECOND SCHEDULE.

ALL that area in the Auckland Land District, Thames County, situated in Block XVI, Tairua Survey District, being the Whangamata Township, and bounded as follows: Towards the north-east generally by the Whangamata Harbour; towards the south-east generally by the Pacific Ocean; towards the south-west by a foreshore reserve, Section 13, Block XVI, Tairua Survey District, the crossing of a public road, and again Section 13; and towards the north-west by the crossing of a public road, Section 13 aforesaid, and the crossing of Beach Road.

As the same is more particularly delineated on the plan marked N. 6/108, deposited in the Department of Mines at Wellington, and thereon edged red.

As witness the hand of His Excellency the Governor-General, this 23rd day of May, 1938.
