Regulations under the Naval Defence Act, 1913, amended.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 11th day of May, 1938.
Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers and authorities conferred on him
by section twenty-five of the Naval Defence Act, 1913, and of all
other powers and authorities enabling him in that behalf, His Excellency
the Governor-General, with the advice of the Executive Council, doth hereby
amend and supplement the regulations referred to in the Schedule hereto
as shown therein.
Article 51: Cancel, and substitute:-
51. Entry of Recruits, Engagements, Re-engagements, &c.-Candidates for entry must be the sons of British-born subjects. They will normally
be required to engage for a period of twelve years from date of entry, or, if
under the age of eighteen years, until that age is reached and for twelve
years thereafter.
2. Subject to the proviso that the candidate is not more than one month
older than the maximum age-limit on the date when final entry would be
effected, the date of application for entry shall be taken in deciding the
age qualification of a candidate who would otherwise be too old for entry
if this were determined from the date of actual engagement. In such cases,
particularly, every effort should be made to reduce the time taken to effect
final entry to an absolute minimum.
3. All candidates for entry will be required to be of the physical standard
laid down from time to time for the various classes of ratings, and to pass
the prescribed medical and, if so ordered, educational examination. The
Director of Recruiting is authorized finally to enter or reject candidates who
have already been provisionally entered.
4. Ratings may be permitted, at the discretion of the Naval Board, to
re-engage for further periods of five years each, but in certain cases the
Board may authorize shorter periods of re-engagement.
5. Subject to requirements and suitability for further service, ratings
may normally be permitted to re-engage when within two years of com-
pleting their current engagements. In normal circumstances re-engagements
should be effected for the unexpired portion of the current engagement
plus a period of five years or such lesser period as may be authorized, but
see clause 6 below.
6. Ratings selected for the purpose of qualifying abroad for officer rank
will be required to re-engage to serve for a period of five years from the
anticipated date of completion of the course.
7. Ratings will not be selected for the purpose of qualifying abroad for
higher substantive or non-substantive rating unless the conditions of
re-engagement as prescribed hereunder are satisfied:-
(a) Ratings qualifying for Mechanician, Observer's Mate, and Air Gunner
will be required to re-engage to serve for a period of five years from
the date of expiration of their first twelve years' engagement.
(b) Ratings qualifying for Gunner's Mate, Torpedo Gunner's Mate, V/S 1
and W/T 1, will be required to re-engage to serve for a period of
five years from the anticipated date of completion of the course.
(c) Ratings qualifying abroad in all other substantive or non-substantive
rates will be required to re-engage to serve for a period of three
years from the anticipated date of completion of the course.
NOTE.-Where any rating is under orders to serve in the Royal
Navy for a period to gain experience after he has qualified for
higher substantive or non-substantive rate, this period of service
is to be regarded as part of a qualifying course for purposes of
re-engagement.
8. Applications for courses are not to be made until it has been verified
that the conditions of the preceding paragraphs are satisfied.
9. Ratings shall be compulsorily retired at the following age-viz.,
Chief and Petty Officers, fifty years; other ratings, forty-five years. Subject
to the foregoing, ratings will generally be compulsorily retired after twenty-
two years man's service, but the Naval Board may from time to time call for
applications from ratings who are qualified by age to re-engage for periods
of three or five years after completing twenty-two years' service. No
applications are to be forwarded unless steps are taken by the Board to call
for them.
