three calendar months’ previous notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the last-known address of the trustees in New Zealand.

  1. The trustees shall see that no nuisance is caused, and that no fish or fish offal shall remain on or about the said site.

  2. In case the trustees shall—
    (1) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them;
    (2) Cease to use or occupy the said site for a period of thirty consecutive days;
    (3) Fail to pay the sums specified in clause 3 of these conditions; or
    (4) Become bankrupt, or be brought under the operation of any law for the time being in force relating to bankruptcy—
    then, and in any of the said cases, this Order in Council, and every right, power, or privilege, may be revoked and determined by the Governor-General in Council without any notice to the trustees or other proceedings whatsoever; and publication in the Gazette of an Order in Council containing such revocation shall be sufficient notice to the trustees, and to all persons concerned or interested, that this Order in Council, and the rights and privileges thereby granted and conferred, have been revoked and determined.

  3. The occupation of the site shall be deemed to be an acceptance by the trustees of the conditions of this Order in Council.

Consenting to the Raising of Part (£35,000) of the Poverty Bay Electric-power Board’s Loan of £65,000 and prescribing the Conditions thereof.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 12th day of April, 1938.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS by Order in Council made on the twenty-seventh day of April, one thousand nine hundred and thirty-one, consent was given to the raising by the Poverty Bay Electric-power Board (hereinafter called “the said local authority”) of the sum of sixty-eight thousand pounds (£68,000) by a loan to be known as “Extensions Loan, 1930” (hereinafter called “the said loan”), of which the sum of thirty thousand pounds (£30,000) has been borrowed:

And whereas by section nine of the Local Authorities Interest Reduction and Loans Conversion Amendment Act, 1934, the authority conferred by the said Order in Council was revoked, in so far as it had not been exercised, and it is not now lawful or competent for the said local authority to borrow any moneys to which such Order in Council relates except in accordance with the provisions of an Order in Council that may be made under section eleven of the Local Government Loans Board Act, 1926:

And whereas the said local authority is desirous of borrowing a further thirty-five thousand pounds (£35,000), and it is expedient to authorize the said local authority to borrow on the conditions hereinafter mentioned the said sum of thirty-five thousand pounds (£35,000) (hereinafter called “the said sum”), being portion of the moneys to which the said Order in Council relates:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, and by section nine of the Local Authorities Interest Reduction and Loans Conversion Amendment Act, 1934, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the borrowing by the said local authority of the said sum of thirty-five thousand pounds (£35,000) for the purpose for which the said loan was authorized, and in giving such consent doth hereby determine as follows:—
(1) The term for which the said sum or any part thereof may be raised shall not exceed ten (10) years.
(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.
(3) The said sum, together with interest thereon, shall be repaid as follows:—
(a) By twenty equal payments of one thousand two hundred and twenty-four pounds and sixpence (£1,224 0s. 6d.), one of such payments to be made at the end of every half-year commencing from the date on which the said sum is borrowed. Each such half-yearly payment shall be applied firstly in payment of interest computed at the rate of three pounds ten shillings (£3 10s.) per centum per annum on the amount of the principal for the time being outstanding at the beginning of each such half-year, and the balance of such half-yearly payment in reduction of such principal.
(b) By a payment at the end of the tenth year from the date of the borrowing of the said sum of a sum equal to the amount to which the said principal has been reduced in accordance with the preceding paragraph (a) hereof after payment of the aforesaid twenty (20) half-yearly payments:
(4) The payment of such instalments shall be made in New Zealand and no such instalment shall be paid out of loan-money.
(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said sum shall not in the aggregate exceed one-half per centum of any amount raised.
(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Variation of Order in Council prohibiting Alienation of Native Land.

ORDER IN COUNCIL.
At the Government House at Wellington, this 26th day of April, 1938.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to section four hundred and forty-two of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary an Order in Council made on the seventh day of December, one thousand nine hundred and thirty-two, and published in the Gazette on the eighth day of December, one thousand nine hundred and thirty-two, at page 2509, and affecting Tokaanu B 1p and other blocks by excluding therefrom the land described in the Schedule hereto.

IN pursuance and exercise of the powers conferred upon him by the Exhibitions Act, 1910 (hereinafter called “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the holding of a public exhibition of works of industry and art, to be conducted by the Auckland Agricultural and Pastoral Association and the Auckland Manufacturers’ Association at the Epsom Show Grounds, Auckland, from the fourth day of May, one thousand nine hundred and thirty-eight, to the fourteenth day of May, one thousand nine hundred and thirty-eight (both days inclusive),
