And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary the determinations aforesaid in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that in lieu of making provision for the repayment of the said loan by establishing a sinking fund in respect thereof the said local authority may raise the said loan upon terms of making the same, together with interest thereon, repayable by equal aggregate annual or half-yearly instalments extending over the period of twenty (20) years.

Little George Street, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 23rd day of March, 1938.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the sixteenth day of December, one thousand nine hundred and thirty-seven, viz.:

"The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to any portion of Little George Street";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern boundary of Little George Street (described in the Schedule hereto) within a distance of sixty-six feet from the south-western boundary of the said street.

SCHEDULE.

All that street situated in the Wellington Land District, City of Wellington, known as Little George Street, adjoining or passing through parts Sections 642 and 643, City of Wellington. As the same is more particularly delineated on the plan marked P.W.D. 98611, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portions of Douglas Terrace and Montague Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 23rd day of March, 1938.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the thirty-first day of January, one thousand nine hundred and thirty-eight, viz.:

"That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz.:

(a) The south-eastern side of portion of Douglas Terrace abutting on Lots 26 and 27 and part of Lot 25, Block II, Township of Dalkeith; and

(b) The northern side of portion of Montague Street abutting on Lot 27, Block II, Township of Dalkeith";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Douglas Terrace or the north-eastern side of the portion of Montague Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

The south-eastern side of all that portion of street, in the Otago Land District, City of Dunedin, known as Douglas Terrace, fronting Allotments 26 and 27 and part of Allotment 25, Block II, Township of Dalkeith.

Also the north-eastern side of all that portion of street in the said land district and city known as Montague Street, fronting Lot 27, Block II, Township of Dalkeith.

As the same are more particularly delineated on the plan marked P.W.D. 98593, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Also the north-eastern side of all that portion of street situated in the said land district and city known as Cooper Street, fronting Lot 294, Glen Estate.

As the same are more particularly delineated on the plan marked P.W.D. 98594, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.
