And whereas it is deemed expedient to alter and redefine the boundaries of the said district accordingly:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby—

  1. Alter and redefine the boundaries of the said district so constituted as aforesaid;

  2. Declare that the boundaries of the said district shall be those set forth in the Schedule hereto; and, further

  3. Declare that this Order in Council shall come into force on the day following publication hereof in the Gazette.

SCHEDULE.

BOUNDARIES OF THE OTOROHANGA RABBIT DISTRICT.

ALL that area in the Auckland Land District, Otorohanga and Waitomo Counties, situated in Blocks VIII, XI, XII, XIV, XV, XVI, Pirongia Survey District, Blocks II, III, IV, VI, VII, VIII, X, XI, XII, XV, XVI, Orahiri Survey District, Blocks V, VI, IX, X, XIII, XIV, Mangaorongo Survey District, and Block I, Pakaumanu Survey District, bounded commencing at a point being the south-western corner of Section 9s, Tahaia Settlement, Block VIII, Orahiri Survey District; in an easterly direction generally along the southern boundaries of Sections 9s and 10s, Tahaia Settlement; thence along the eastern boundary of Section 10s aforesaid, the southern and eastern boundaries of Lot 2 on D.P. 24575, being a subdivision of portion of Tahaia B 2A Block, to and along the Mangawhero Road to the western boundary of Tahaia B 2c 1B Block; thence in a southerly direction generally along the western boundaries of Tahaia B 2c 1B, B 2c 3B 1, and B 2c 3B 2B 2 Blocks to the southern boundary of Block V, Mangaorongo Survey District; thence again in an easterly direction generally along this block-line to and along the western boundary of Section 3, Block V, Mangaorongo Survey District, to and across a public road; thence in a north-easterly direction generally along the south-eastern side of this road to the Waipa River Road; thence in a south-easterly direction generally along the Waipa River Road to the northernmost corner of Rangitoto-Tuhua 33c 3B 3A Block; thence in a general southerly direction along the north-western boundary of 33c 3B 3A Block aforesaid, to and along the northern boundary of Rangitoto-Tuhua 32B 2 Block to the Mangapohue Stream; thence up the Mangapohue Stream to the north-western corner of Rangitoto A 37B 3 Block, along the western boundary of the last-mentioned block, the north-western boundary of Rangitoto A 35B Block, to the north-eastern corner of Rangitoto-Tuhua Part 35E 1B Block; thence in a westerly direction generally along the northern and western boundaries of Rangitoto-Tuhua part 35E 1B Block, to and along the southern boundary of Rangitoto-Tuhua 26B Block and its production in a westerly direction to the western side of Otewa Road; thence in a southerly direction generally along the western side of Otewa Road to its junction with Puketawai Road; thence in a north-westerly direction generally along the Puketawai Road to a public road; thence along that public road to the north-eastern boundary of Rangitoto-Tuhua 70A Block; thence along the north-eastern boundary of Rangitoto-Tuhua 70A Block, the north-eastern and north-western boundaries of Rangitoto-Tuhua 64A Block, to and along the Mangarapa Stream to the northernmost corner of Te Kuiti 2B 23 Block; thence along the north-western boundary of the last-mentioned block, the north-eastern and north-western boundaries of Section 4, Block XVI, Orahiri Survey District, the northern boundaries of Pukeroa-Hangatiki 3B 2, 3A 1, 3A 2A, and 3A 2B Blocks, to and along the north-eastern boundary of Section 13, Block XV, Orahiri Survey District, and the north-eastern boundary of Te Kumi 7D 2D 2A Block, to and across the Main Trunk Railway; thence in a north-easterly direction generally along the eastern boundaries generally of Te Kumi 7D 2B, 7D 2A, and 7D 1 Blocks to the Mangaokewa Stream; thence along the Mangaokewa Stream and up the Mangapu Stream to the Waitomo Caves Road; thence in a westerly direction generally along the Waitomo Caves Road to its junction with the Tapuae Road; thence in a northerly direction generally along the Tapuae Road to its intersection with the northern boundary of Hauturu East B 2 No. 2F 1 Block; thence across the Tapuae Road and along the northern boundary of the last-mentioned block to the Moakurarua Stream; thence along the Moakurarua Stream to its confluence with the Waipa River; thence in a southerly direction generally up the Waipa River to its intersection with the Otorohanga - Te Kuiti Road; thence along this road to a point in line with the southern boundary of Section 9s, Tahaia Settlement; thence along a right line to the south-western corner of Section 9s, Tahaia Settlement, the point of commencement.

Authorizing the Borrowing by the Rotorua Borough Council by Way of Hypothecation of Debentures issued in respect of a Loan of £8,300.

At the Government House at Wellington, this 9th day of February, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council made on the ninth day of February, one thousand nine hundred and thirty-eight, consent was given to the raising in New Zealand by the Rotorua Borough Council (hereinafter called “the said local authority”) of the sum of eight thousand three hundred pounds (£8,300) by a loan to be known as “Library Bequest Loan, 1937” (hereinafter called “the said loan”), such consent being given subject to the determinations as to borrowing and repayment therein set out, including, inter alia, the provision that the rate of interest that might be paid in respect of the said loan or any part thereof should be such as should not produce to the lender or lenders a rate or rates exceeding three pounds ten shillings (£3 10s.) per centum per annum:

And whereas the said local authority, pending the raising of the said loan in accordance with the said determinations, is desirous of borrowing the said amount or part thereof by hypothecation or mortgage pursuant to section thirty-four of the Local Bodies’ Loans Act, 1926, of the debentures authorized to be issued in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section seven of the Local Authorities Interest Reduction and Loans Conversion Act, 1932–33, and by section eight of the Local Authorities Interest Reduction and Loans Conversion Amendment Act, 1933, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the said local authority, pending the raising of the said loan in accordance with the said determinations, borrowing the said amount or any part thereof by the hypothecation or mortgage of the said debentures at a rate of interest not exceeding four pounds ten shillings (£4 10s.) per centum per annum, and hereby prescribes that the money borrowed by the hypothecation or mortgage of the said debentures shall, pending the raising of the said loan, be repaid by annual amounts equivalent to the instalments of principal which would have been repaid if on the first date on which any moneys are borrowed by such hypothecation or mortgage the whole of the said loan of eight thousand three hundred pounds (£8,300) had been raised on the terms prescribed by the said Order in Council made on the ninth day of February, one thousand nine hundred and thirty-eight.
