Portions of Streets in the Borough of West Harbour exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 16th day of February, 1938.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolutions passed by the West Harbour Borough Council on the seventh day of December, one thousand nine hundred and thirty-seven, viz. :—
(a) “The West Harbour Borough Council, being the local authority having control of the streets in the Borough of West Harbour, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Dunedin – Port Chalmers Highway adjoining part of Section 53, Block IX, North Harbour and Blueskin Survey District ”;
(b) “The West Harbour Borough Council, being the local authority having control of the streets in the Borough of West Harbour, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of View Street adjoining Allotments 15, 16, 17, 18, 19, and 20, Township of Burkes Brewery ”;
(c) “The West Harbour Borough Council, being the local authority having control of the streets in the Borough of West Harbour, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the Dunedin – Port Chalmers Highway adjoining Allotments 6 and 7 and part Allotment 5 and Elisabeth Street adjoining Allotments 9, 11, and 13, Block II, Township of Herne Bay ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portions of streets (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.
SCHEDULE.
THE north-western side of all that portion of street, in the Otago Land District, Borough of West Harbour, known as the Dunedin – Port Chalmers Main Highway, fronting part Section 53, Block IX, North Harbour and Blueskin Survey District; coloured red on plan.
Also the south-eastern side of all that portion of street in the said land district and borough, known as View Street, fronting Allotments 15, 16, 17, 18, 19, and 20, Township of Burkes Brewery; coloured red on plan.
Also the north-eastern side of all that portion of street in the said land district and borough, known as Elisabeth Street, fronting Allotments 9, 11, and 13, Block II, Township of Herne Bay; edged red on plan.
Also the north-western side of all that portion of street in the said land district and borough, known as the Dunedin – Port Chalmers Main Highway, fronting Allotments 6 and 7 and part Allotment 5, Block II, Township of Herne Bay; edged red on plan.
As the same are more particularly delineated on the plans marked P.W.D. 98052, 98058, and 98057, deposited in the office of the Minister of Public Works at Wellington.

“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz. :—
(a) The north-eastern side of Waverley Street abutting on part Section 8, Block VII, Town District, and
(b) The north-western side of portion of Cargill Road abutting on part Section 8, Block VII, Town District ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of Waverley Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said street, or on the land fronting the north-western side of portion of Cargill Road (described in the Schedule hereto) within a distance of sixty-six feet from the opposite side of the said street.
SCHEDULE.
THE north-eastern side of all that street, situated in the Otago Land District, City of Dunedin, known as Waverley Street, fronting part Section 8, Block VII, Town District.
Also the north-western side of all that portion of street situated in the said land district and city, known as Cargill Road, fronting part Section 8, Block VII, Town District.
As the same are more particularly delineated on the plan marked P.W.D. 98353, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.
