A PROCLAMATION.

BY virtue and in exercise of the powers and authorities conferred upon me by section eighteen of the Forests Act, 1921-22, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby set apart the Crown land described in the Schedule hereto as a permanent State forest.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT—AUCKLAND FOREST-CONSERVATION REGION.

ALL that area in the North Auckland Land District, Hobson County, containing by admeasurement 664 acres 1 rood 31 perches, more or less, being Section 22, Block X, Tutamoe Survey District, and formerly known as portion of Section 2, Block X, Tutamoe Survey District.

As the same is more particularly delineated on plan No. 8/26, deposited in the Head Office of the State Forest Service, at Wellington, and thereon bordered red. (North Auckland plan 29269.)

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 8th day of February, 1938.

A PROCLAMATION.

IN pursuance and exercise of the powers conferred by subsection nine of section twelve of the Land Act, 1924, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that from and after the date hereof the land comprised in the piece of closed road described in the First Schedule hereto, being an area adjacent to the reserve for cemetery purposes described in the Second Schedule hereto, shall be deemed to be added to the said reserve.

FIRST SCHEDULE.

AUCKLAND LAND DISTRICT.

SECTION 530, Town of Pirongia East: Area, 3 roods 19·5 perches, more or less. As the same is delineated on the plan marked L. and S. 2/603A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. (Auckland plan 29042.)

SECOND SCHEDULE.

AUCKLAND LAND DISTRICT.

SECTION 334, Town of Pirongia East (formerly Alexandra East): Area, 1 acre 0 roods 39 perches, more or less. As the same is delineated on the plan marked L. and S. 2/603B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged blue. (Auckland plan 313.)

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 15th day of February, 1938.

At the Government House at Wellington, this 16th day of February, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to Edward Percy Harold Burbury, of Glen Wye, Culverden, Farmer (hereinafter referred to as "the licensee"), a license subject to the conditions hereinafter set forth to take and use from an unnamed stream situated in Section 5, Block VIII, Skiddaw Survey District, in the Land District of Canterbury, for the purposes hereinafter set forth a stream of water not exceeding two and one-half cubic feet per second at any one time.

CONDITIONS.

  1. IMPLIED CONDITIONS.

The conditions directed to be implied in all licenses by the Water-power Regulations, 1934, shall be incorporated in and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENSE SUBJECT TO REGULATIONS.

This license is issued under the Water-power Regulations, 1934, and is subject thereto and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.

  1. UTILIZATION OF WATER AND LOCATION OF HEADWORKS.

Water shall be used under this license solely for the purpose of generating electricity up to a maximum capacity of one kilowatt at 230 volts direct current, and shall be taken from the stream at the point in Section 5, Block VIII, Skiddaw Survey District, indicated on the plan marked P.W.D. 83378, deposited in the office of the Minister of Public Works.

  1. GENERAL DESCRIPTION OF WORKS.

The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the positions of the said works being indicated on the said plan P.W.D. 83378:—(a) Headworks consisting of an intake, water-race, and pipe-lines leading to the water-wheel and powerhouse hereinafter referred to, giving a static head of approximately 10 ft. (b) A power-house with all necessary equipment, for generating electricity. (c) Tail-race leading from the said water-wheel to the said stream.

  1. SYSTEM OF SUPPLY.

The system of supply shall be as described in paragraph (d) of clause 21-01 of the Electrical Supply Regulations, 1935. The generating voltage and the transmission voltage shall be approximately 230 volts direct current.

  1. DURATION OF LICENSE.

Unless sooner determined, this license shall continue in force until the 31st day of March, 1958.

  1. RENTAL.

For the purpose of assessing the annual rental payable in respect of this license, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and, failing such installation, the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 1 kilowatt, and falls within the classes described in paragraph (c) of subclause (b) of clause (1) of Regulation 6 of the Water-power Regulations, 1934.
