Portion of Harbour Street, in the City of Auckland, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 24th day of November, 1937.
Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the fifteenth day of July, one thousand nine hundred and thirty-seven, viz.:—
“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Harbour Street, Ponsonby, fronting part Lot 1, D.P. 8905, being part Allotment 14, Section 8, Suburbs of Auckland, comprised in C.T. 306/39 ”; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Harbour Street (described in the Schedule hereto), within a distance of twenty-five feet from the centre-line of the said portion of street.

SCHEDULE.
The south-western side of all that portion of street, in the North Auckland Land District, City of Auckland, known as Harbour Street fronting part Lot 1, D.P. 8905, being part Allotment 14, Section 8, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 96993, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Authorizing the Laying-off of a proposed Street in the Borough of Mount Eden of a Width less than 66 ft. but not less than 44 ft., subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 24th day of November, 1937.

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Mount Eden Borough Council to lay off the proposed street described in the Schedule hereto of a width less than sixty-six feet, but not less than forty-four feet, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said proposed street and shown coloured blue on the plan marked P.W.D. 96985 referred to in the said Schedule.

SCHEDULE.
THAT proposed street, in the North Auckland Land District, Borough of Mount Eden, containing by admeasurement 39 perches, more or less, being Lot 7, D.P. 18136, and being part Allotment 95, Section 10, Suburbs of Auckland, Block IV, Titirangi Survey District. As the same is more particularly delineated on the plan marked P.W.D. 96985, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Marton Borough Council on the eleventh day of October, one thousand nine hundred and thirty-seven, viz.:—
“ The Marton Borough Council, being the local authority having control of the streets in the Borough of Marton, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the street known as Signal Street adjoining Lot twenty-seven and part thirty-two, and shall not apply to that portion of the street known as Maunder Street adjoining Lot 27 (Volume 342, folio 54, Wellington District Land Registry), Deposited Plan No. 7710 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Signal Street or on the land fronting the eastern side of the portion of Maunder Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.
THE northern side of all that portion of street, situated in the Wellington Land District, Borough of Marton, known as Signal Street, fronting Lot 27 and part Lot 32, D.P. 7710.
Also the eastern side of all that portion of street situated in the said land district and borough, known as Maunder Street, fronting Lot 27, D.P. 7710.
As the same are more particularly delineated on the plan marked P.W.D. 97074, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the seventh day of October, one thousand nine hundred and thirty-seven, viz.:—
“ That the Nelson City Council, being the local authority having control of the streets of the City of Nelson, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Scotland Street adjoining part Section 598 N.R ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Scotland Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.
