exempted from the Provisions of Section 128 of the Public
Works Act, 1928, subject to a Condition as to the Building-
line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 8th day of
September, 1937.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Marton Borough Council on the
ninth day of August, one thousand nine hundred and thirty-
seven, viz.:-

"That the Marton Borough Council, having control of
the streets in the Borough of Marton, by resolution declares
that the provisions of section 128 of the Public Works
Act, 1928, shall not apply to those portions of Morris and
Robert Streets fronting Lots 118, 119, and 120, Deeds
Plan 22, Town of Marton, and coloured blue on plan ";

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the northern
side of the portion of Morris Street, or fronting the western
side of the portion of Robert Street (described in the Schedule
hereto), within a distance of thirty-three feet from the centre-
lines of the said portions of streets.

SCHEDULE.

THE northern side of all that portion of street, situated in
the Wellington Land District, Borough of Marton, known as
Morris Street, fronting Allotments 118, 119, and 120, Deeds
Plan 22, Town of Marton.

Also the western side of all that portion of street, situated
in the said land district and borough, known as Robert
Street, fronting Allotment 118, Deeds Plan 22, Town of
Marton.

As the same are more particularly delineated on the plan
marked P.W.D. 96931, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured blue.

on the northern boundary of Lot 3 of Sections 20 and 20A,
Block XI, Kaiteriteri S.D., as shown on plan prepared by
F. A. C. Staig, Registered Surveyor, and coloured red
thereon";

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the portions
of roads (described in the Schedule hereto) within a distance
of thirty-five feet from the centre-lines of the said portions
of roads.

SCHEDULE.

THE eastern side of all that portion of road in the Nelson
Land District, County of Waimea, fronting Lot 3, D.P. 602,
being part Sections 20 and 20A, Motueka Original District,
Block XI, Kaiteriteri Survey District.

Also the southern side of all that portion of road in the
said land district and county, fronting Lot 3, D.P. 602,
being part Sections 20 and 20A, Motueka Original District,
Block XI, Kaiteriteri Survey District.

As the same are more particularly delineated on the plan
marked P.W.D. 96616, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

shall not apply to that portion of the northern half of King
Edward Street fronting Lot 6, D.P. 1481, being part
Section 165, N.R., Motueka Original District, Block IV,
Motueka Survey District";

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the northern
side of the portion of King Edward Street (described in the
Schedule hereto) within a distance of thirty-five feet from the
centre-line of the said portion of street.

SCHEDULE.

THE northern side of all that portion of street, situated in
the Nelson Land District, Borough of Motueka, known as
King Edward Street, fronting Lot 6, D.P. 1481, being part
Section 165 (N.R.), Motueka Original District, Block IV,
Motueka Survey District. As the same is more particularly
delineated on the plan marked P.W.D. 96737, deposited in
the office of the Minister of Public Works at Wellington, and
thereon coloured red.
