Portion of a Road in the County of Clutha exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 8th day of September, 1937.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Clutha County Council on the twenty-ninth day of July, one thousand nine hundred and thirty-seven, viz.:-
"That the Clutha County Council, being the local authority having control of the roads in the Clutha County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of road adjoining Sections 5 and 7, Block LVIII, Clutha Survey District, shown coloured red on the plan";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE western side of all that portion of road, situated in the Otago Land District, County of Clutha, fronting Sections 5 and 7, Block LVIII, Clutha Survey District. As the same is more particularly delineated on the plan marked P.W.D. 96815, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

SCHEDULE.

ALL those portions of roads in the Otago Land District, County of Taieri, adjoining or passing through Section 1, Block II, Otokia Survey District, and Section 68, Irregular Block, East Taieri Survey District.
Also the northern side generally of that portion of road in the said land district and county fronting Section 2 of 31, Block I, and Section 1, Block II, Otokia Survey District.
As the same are more particularly delineated on the plan marked P.W.D. 96416, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

"That the Waimea County Council, being the local authority having control of the roads within the Waimea County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the following roads, namely :-
"(a) The eastern side of the road fronting the western boundary of part Section 4, Suburban North, Block IX, Wakapuaka S.D., marked A-B on plan dated May, 1937, prepared by F. I. Ledger, Registered Surveyor, and coloured red thereon;
"(b) The eastern side of the road fronting the western boundary of part Section 4, Block IX, Wakapuaka S.D., for a distance of 1462 links, marked A-B on plan dated April, 1937, prepared by F. I. Ledger, Registered Surveyor, and coloured pink thereon;
"(c) The south-eastern side of the road on the north-western boundary of part Section 9, Block VI, Waimea S.D. (C.T. 57/35), for a distance of 2049 links, marked A-B on plan dated June, 1937, prepared by F. I. Ledger, Registered Surveyor, and coloured pink thereon;
"(d) The north-eastern side of the road on the south-western boundary of part Section 9, Block VI, Waimea S.D., marked C-D on plan dated June, 1937, prepared by F. I. Ledger, Registered Surveyor, and coloured pink thereon;
"(e) The western side of the road fronting the eastern boundary of Section 70, Block IX, Waimea S.D., marked A-B on plan dated June, 1937, prepared by F. I. Ledger, Registered Surveyor, and coloured pink thereon";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portions of roads (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.
