Selwyn Plantation Regulations, 1937.
GALWAY, Governor-General.
PURSUANT to section seventy-seven of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1910, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby make the regulations hereinafter set out.
REGULATIONS.
PRELIMINARY.

These regulations may be cited as the Selwyn Plantation Regulations, 1937.

These regulations shall be read together with and be deemed to form part of the Selwyn Plantation Regulations, 1931 (hereinafter referred to as “the principal regulations”).

These regulations shall come into force on the 29th day of July, 1937.

In these regulations—
“Business of the Board” includes attendance at meetings of the Board or any committee of members of the Board, but otherwise does not include any business other than business authorized by law to be performed by a member and transacted by such member pursuant to a resolution of the Board.

Nothing in these regulations shall apply to a member of the Board who is an officer of the Public Service.

Regulation (2) of the principal regulations is hereby amended by the addition, after the words “‘Commissioner,’ means the Commissioner of Crown Lands for the Canterbury Land District,” of the words, “or his Deputy.”

Regulation 33 of the principal regulations is hereby revoked.
FEES.
- Except as provided by subclause (c) of Regulation 13 hereof, there shall be paid to each member for each day or part of a day on which he is engaged upon the business of the Board a fee of 10s.
LOCOMOTION EXPENSES AND ALLOWANCES.

Subject as hereinafter provided, there shall be paid to each member all locomotion-expenses actually and reasonably incurred by him in attending to the business of the Board, including the provision of first-class accommodation by rail, tram, motor-vehicle, or other public conveyance.

Where a public conveyance is available such locomotion-expenses shall be computed according to the most direct route from the member’s usual place of residence, save that if public conveyances following the most direct route are, having regard to the time or place of departure or arrival, substantially inconvenient for the use of the member, he may with the permission of the Chairman use a public conveyance following some other route.

(1) Where a public conveyance is not available for any part of the journey or is available only at a cost greater than the sum allowable under paragraph (b) of this regulation, there shall be paid to a member in respect of his transport for such part of the journey as aforesaid whichever of the two following sums is the less, namely:—
(a) Fares actually paid for cab or other private conveyance not belonging to a member; or
(b) An allowance for the use of the member’s own horse or vehicle at a rate of 6d. per mile (counted each way), together with the actual cost of stabling or garage expenses not exceeding 5s. for each night that a horse or vehicle has to be kept away from the member’s usual place of residence:
Provided that where more members than one share the same means of transport only one set of charges shall be allowed under this regulation.
(2) For the purposes of this regulation a public conveyance shall be deemed to be not available when no public conveyance is available except such as having regard to the time or place of departure or arrival are in the opinion of the Chairman substantially inconvenient for the use of the member.
- An allowance equivalent to the expenses and allowances aforesaid shall be paid if in lieu of using a public conveyance or privately hired conveyance the member in fact elects to use any other means of transport.
LIVING EXPENSES AND ALLOWANCES.
- (a) When his attendance on the business of the Board requires a member to absent himself from his usual place of residence continuously for a period of twenty-four hours or longer, there shall be paid to such member an allowance for living-expenses at the rate of £1 per day of twenty-four hours and a proportionate sum for any part of a day with a minimum of 10s. for every day (counted from midnight to midnight) in respect of which the allowance provided by this regulation is claimed for and paid.
(b) Such period shall be computed from and to the exact hours nearest to the times of departure from and return to the member’s usual place of residence.
(c) In respect of any period for which the sum payable under this regulation is allowed, the fees payable under Regulation 8 hereof shall not be payable.
(d) The Board may with the sanction of the Controller and Auditor-General approve payment to any member in lieu of the payment set out in the foregoing provisions of this regulation a sum not exceeding the expenses actually and reasonably incurred and paid by that member, and such approval may be given either generally in respect of the expenses of any member or in respect of a particular occasion, and may be given either before or after the business of the Board is attended to which gives rise to the claim.
DOUBLE ALLOWANCES.
- No locomotion expenses or allowances or living expenses or allowances shall be paid in respect of any occasion on which locomotion expenses or allowances or living expenses or allowances are paid to the member from any other person, body corporate, or public or administrative body:
Provided that nothing contained in this regulation shall prevent the Board from making or receiving payments to or from any such person or body by way of apportionment of expenses or allowances payable to any member by reason of his being engaged both upon the business of the Board and also upon the business of such person or body.
CERTIFICATE.
- No payment to any member for fees or expenses under these regulations shall be made until such member has signed a claim setting out the particulars of the amounts payable and unless such claim is accompanied by a certificate signed by the member stating that on the days claimed for he was engaged on the business of the Board and incurred any expenses set out as such in the claim and that the claim is correct in all particulars, and further stating and undertaking that the member has not already been paid any sum and will not claim or accept any sum by or from any other person, body corporate, or public or administrative body in respect of the same locomotion expenses or allowances or living expenses or allowances or in respect of travelling or living expenses on the same occasion.
