At the Government Buildings at Wellington, this 10th day of June, 1937.

Present:
THE HON. P. FRASER PRESIDING IN COUNCIL.

Pursuant to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to William Oliver Rutherford, of Marble Point, Culverden, Farmer (hereinafter referred to as “the licensee”), a license subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of the Twenty-one Mile Stream situated in Section 37, Block XVI, Tekoa Survey District, in the Land District of Canterbury, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding one-quarter of a cubic foot per second at any one time.

CONDITIONS.

  1. IMPLIED CONDITIONS.

The conditions directed to be implied in all licenses by the Water-power Regulations, 1934, shall be incorporated in and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENSE SUBJECT TO REGULATIONS.

This license is issued under the Water-power Regulations, 1934, and is subject thereto and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.

  1. UTILIZATION OF WATER AND LOCATION OF HEADWORKS.

Water shall be used under this license solely for the purpose of generating electricity up to a maximum capacity of one-half of a kilowatt at 230 volts direct current, and shall be taken from the stream at the point in Section 37, Block XVI, Tekoa Survey District, indicated on the plan marked P.W.D. 95624, deposited in the office of the Minister of Public Works.

  1. GENERAL DESCRIPTION OF WORKS.

The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the positions of the said works being indicated on the said plan P.W.D. 95624:—

(a) Headworks consisting of an intake and dam; surge chamber and pipe-line leading to the water-wheel and power-house hereinafter referred to.

(b) A power-house with all necessary equipment, including water turbines, generators, transformers, lightning-arresters, switchboards, switches, exciters, and other appliances for generating electricity.

(c) Tail-race leading from the power-house to the said stream, the static head being approximately 41 ft.

  1. SYSTEM OF SUPPLY.

The system of supply shall be as described in paragraph (d) of clause 21-01 of the Electrical Supply Regulations, 1935. The generating voltage and the transmission voltage shall be approximately 230 volts direct current.

  1. DURATION OF LICENSE.

Unless sooner determined, this license shall continue in force until the 31st day of March, 1958.

  1. RENTAL.

For the purpose of assessing the annual rental payable in respect of this license, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and, failing such installation, the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at one-half of a kilowatt, and falls within the classes described in paragraph (b) of clause (2) of Regulation 6 of the Water-power Regulations, 1934.

Pursuant to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to William Manson Sutherland, of Omarama, Farmer (hereinafter referred to as “the licensee”), a license subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of the Wairepo Creek situated in Section 1, Block 8, Ohau River Survey District, in the Land District of Otago, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding three cubic feet per second at any one time.

CONDITIONS.

The conditions directed to be implied in all licenses by the Water-power Regulations, 1934, shall be incorporated in and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  1. GENERAL DESCRIPTION OF WORKS.

The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the positions of the said works being indicated on the said plan P.W.D. 95453:—

(a) Headworks consisting of an intake, dam, water-race, and pipe-lines leading from the intake on Section 1, Block 8 aforesaid, through part Section 1, Run 543, and part P.R.‘B’. on Run 3 of C, all situated in Ohau River Survey District, to the water-wheel and power-house hereinafter referred to, giving a static head of approximately 65 ft.

(b) A power-house situated on part of P.R.‘B’. on Run 3 of C, Ohau River Survey District, with all necessary equipment, including water turbines, generators, transformers, lightning-arresters, switchboards, switches, exciters, and other appliances for generating electricity.

(c) Tail-race leading from the said water-wheel to a water-race on P.R.‘B’. on Run 3 of C aforesaid.

  1. SYSTEM OF SUPPLY.
