Reapportioning Representation on Opunake Electric-power Board and revoking former Order in Council.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 21st day of May, 1937.
Present:
THE HON. P. FRASER PRESIDING IN COUNCIL.
WHEREAS by Order in Council dated the fifteenth day of August, one thousand nine hundred and twenty-one, published in the Gazette on the eighteenth day of the same month (hereinafter called “the said Order in Council”), apportioning representation on the Opunake Electric-power Board (hereinafter called “the Board”), provision was made for the constituent district of the Opunake Town District to be represented by two members, and the constituent district of part of Egmont County to be represented by five members, on the Board:
And whereas by Proclamation dated the twelfth day of March, one thousand nine hundred and twenty-five, published in the Gazette on the nineteenth day of the same month, the boundaries of the Opunake Electric-power District were altered so as to include all that portion of the Egmont County not theretofore included in the said Opunake Electric-power District:
And whereas in consequence of the constitution as a borough of the area formerly comprising the Opunake Town District the first general election of councillors to the Opunake Borough Council will be held on the eighteenth day of June, one thousand nine hundred and thirty-seven:
And whereas it is expedient to make provision for the first general election to the Board of representatives of the constituent district of the Borough of Opunake, to be held on the same day as the first general election of councillors to the Opunake Borough Council:
Now, therefore, in pursuance and exercise of the powers conferred by the Electric-power Boards Act, 1925, and of every other power in anywise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the said Order in Council, and in lieu thereof doth hereby determine that on and after the said eighteenth day of June, one thousand nine hundred and thirty-seven, the constituent district of the Borough of Opunake shall be represented on the Board by two members, and the constituent district of the County of Egmont shall be represented on the Board by five members; and, further, doth hereby appoint Friday, the eighteenth day of June, one thousand nine hundred and thirty-seven, as the day on which shall be held the first election to the Board of representatives of the constituent district of the Borough of Opunake.

The North-eastern Side of Portion of Vivian Street, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 28th day of May, 1937.

THE HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the first day of February, one thousand nine hundred and thirty-seven, viz.:
“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the northern side of Vivian Street fronting Lots 1 and 2, D.P. 8487”;
the portion of street affected by such resolution being described in the Schedule hereto.
SCHEDULE.
THE north-eastern side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Vivian Street, fronting Lots 1 and 2, D.P. 8487. As the same is more particularly delineated on the plan marked P.W.D. 95183, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Vesting the Control of a Reserve in the Moura Native Burial-ground Board.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 28th day of May, 1937.
Present:
THE HON. P. FRASER PRESIDING IN COUNCIL.
WHEREAS the land described in the Schedule hereto was by Warrant published in Gazette of the twenty-seventh day of May, one thousand nine hundred and twenty, permanently reserved for a Native burial-ground: And whereas it is expedient that the control of the said reserve should be vested in a special Board as hereinafter provided:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the reserve described in the Schedule hereto, for the period of five years from the date hereof (unless previously amended or revoked under the said Act), in the undermentioned persons, namely,—
Karora Hohepa Moke,
Arawhiti Mehaka,
Raimona Heretaunga,
Patiti Paerau, and
Te Whainoa Raureti,
who are hereby constituted for that purpose a special Board by the name of the Moura Native Burial-ground Board (hereinafter referred to as “the Board”), with the powers and subject to the conditions hereinafter contained, that is to say :—

The Board shall meet for the transaction of business at two o’clock p.m. on the first Saturday in the months of February, May, August, and November in each year, at Matata, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Saturday, the seventh day of August, one thousand nine hundred and thirty-seven.

The members of the Board shall at their first meeting elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

Special meetings may be convened by the Chairman, provided that two days’ notice of any such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman of such meeting.

If by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

The Board is hereby empowered to do all things which may be requisite for the proper and beneficial management and administration of the said reserve.

Nothing herein contained shall authorize further burials being made within the boundaries of the said reserve.

AUCKLAND LAND DISTRICT.
Section 5, Block XII, Tarawera Survey District: Area, 44 acres, more or less.
