Order in Council consenting to the Borrowing by the Grey Hospital Board by way of Hypothecation of Debentures issued in respect of a Loan of £9,555.

At the Government Buildings at Wellington, this 28th day of May, 1937.

THE HON. P. FRASER PRESIDING IN COUNCIL.
WHEREAS by Order in Council made on the twenty-eighth day of May, one thousand nine hundred and thirty-seven, consent was given to the raising in New Zealand by the Grey Hospital Board (hereinafter called "the said local authority") of the sum of nine thousand five hundred and fifty-five pounds (£9,555) by a loan to be known as "Alterations and Additions Supplementary Loan, 1937" (hereinafter called "the said loan"), such consent being given subject to the determinations as to borrowing and repayment therein set out, including, inter alia, the provision that the rate of interest that might be paid in respect of the said loan or any part thereof should be such as should not produce to the lender or lenders a rate or rates exceeding three pounds ten shillings (£3 10s.) per centum per annum:
And whereas the said local authority, pending the raising of the said loan in accordance with the said determinations, is desirous of borrowing the said sum or part thereof by hypothecation or mortgage pursuant to section thirty-four of the Local Bodies' Loans Act, 1926, of the debentures authorized to be issued in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section seven of the Local Authorities Interest Reduction and Loans Conversion Act, 1932-33, and by section eight of the Local Authorities Interest Reduction and Loans Conversion Amendment Act, 1933, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the said local authority, pending the raising of the said loan in accordance with the said determinations, borrowing the said sum of nine thousand five hundred and fifty-five pounds (£9,555) or any part thereof by the hypothecation or mortgage of the said debentures at a rate of interest not exceeding four pounds ten shillings (£4 10s.) per centum per annum, and hereby prescribes that the money borrowed by the hypothecation or mortgage of the said debentures shall, pending the raising of the said loan, be repaid by annual amounts equivalent to the instalments of principal which would have been repaid if on the first date on which any moneys are borrowed by such hypothecation or mortgage the whole of the said loan of nine thousand five hundred and fifty-five pounds (£9,555) had been raised on the terms prescribed by the Order in Council made on the twenty-eighth day of May, one thousand nine hundred and thirty-seven.

Order in Council exempting the Waikato Land Settlement Society, Incorporated, from Payment of Land-tax.

WHEREAS by subsection eight of section eight of the Small Farms (Relief of Unemployment) Amendment Act, 1933 (hereinafter called "the said Act"), it is enacted that the Governor-General may, by Order in Council, exempt any land-settlement society from land-tax payable under the Land and Income Tax Act, 1923, with respect to any lands specified in the said Order in Council, and for such period or periods as may be specified therein:
And whereas the Waikato Land Settlement Society, Incorporated, is a society within the meaning of the said Act:
And whereas the lands described in the Schedule hereto are lands which are or have been held by the said society:
Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby exempt the Waikato Land Settlement Society, Incorporated, from payment of land-tax under the Land and Income Tax Act, 1923, in respect of the lands described in the Schedule hereto, for a term of three years commencing on the first day of April, one thousand nine hundred and thirty-seven, or for such shorter period as the said lands are owned by the society within the meaning of the Land and Income Tax Act, 1923, and upon the sale or other disposition of such lands or of any part thereof the exemption hereby granted in respect of the land so sold or otherwise disposed of shall cease.
SCHEDULE.
AUCKLAND LAND DISTRICT.
(I) All that piece of land containing 460 acres 2 roods 14 perches, more or less, situated in Blocks I, II, V, and VI of the Maungatautari Survey District, being Lot l on a plan deposited in the Land Registry Office at Auckland under No. 12622, and being part of the block called Maungatautari No. 4H, Section 8, and being the whole of the land comprised and described in Certificate of Title, Volume 653, folio 188, Auckland Registry.
(2) All that piece of land containing 2 acres 2 roods 2 perches, more or less, being the whole of the land on a plan deposited in the Land Registry Office at Auckland under No. 9515, being portion of a block situate in the Maungatautari Survey District called Puahue No. 2, and being the whole of the land comprised and described in Certificate of Title, Volume 229, folio 198, Auckland Registry.
(3) All that piece of land containing 377 acres 2 roods 16 perches, more or less, being the block situate in the Maungatautari Survey District called Puahue No. 2, Section 7c, and being the whole of the land comprised and described in Certificate of Title, Volume 245, folio 24, Auckland Registry.
(4) All that piece of land containing 1,116 acres, more or less (reduced to 1,109 acres 1 rood 13 perches by Proclamation No. 5339), being Lot No. 66A, No. 2, of the Parish of Waipa, and being the whole of the land comprised and described in Certificate of Title, Volume 211, folio 87, Auckland Registry.
(5) All that piece of land containing 930 acres 3 roods, more or less (reduced to 927 acres 1 rood 4-4 perches by Proclamation No. 5339), being part of Lot 66A, No. 4, of the Parish of Waipa, and being the whole of the land comprised and described in Certificate of Title, Volume 266, folio 6, Auckland Registry.
(6) All that piece of land containing 503 acres, more or less, being the whole of the land on a plan deposited in the Land Registry Office at Auckland under No. 8413, and being portion of the blocks situate in the Maungatautari Survey District called Pukekura No. 15, Pukekura No. 16, and Pukekura No. 17, being all the land comprised and described in Certificate of Title, Volume 205, folio 51, Auckland Registry.
(7) All that piece of land containing 35 acres 0 roods 22 perches, more or less, being Lot 2 on a plan deposited in the Land Registry Office at Auckland under No. 13756, which said parcel of land is portion of the blocks situated in the Maungatautari Survey District called Puahue No. 2 and Pukekura No. 17, being all the land comprised and described in Certificate of Title, Volume 326, folio 256, Auckland Registry.
(8) All that piece of land, containing 1,437 acres 0 roods 8 perches, more or less, being Section 7 and part of Section 4 of Block II of the Wharepapa Survey District, and being the whole of the land comprised and described in Certificate of Title, Volume 312, folio 8, Auckland Registry.
(9) All that piece of land containing 9 acres 1 rood, more or less, being Lot 2 on a plan deposited in the Land Registry Office at Auckland under No. 25423, being portion of Lot No. 66A No. 4 of the Parish of Waipa, and being part of the land comprised in Certificate of Title, Volume 266, folio 5, Auckland Registry.
(10) All that piece of land containing 703 acres 1 rood 36-4 perches, being part of Lot 7 on a plan deposited in the Land Registry Office at Auckland under No. 7303, being portion of Wharepuhunga No. 14B Block, and being the whole of the land comprised in Certificate of Title, Volume 430, folio 50, Auckland Registry.
(11) All that piece of land containing 896 acres 2 roods 23 perches, more or less, being part of Lot 1 on a plan deposited in the Land Registry Office at Auckland under No. 20102, being part of the Wharepuhunga No. 14B Block, and being the whole of the land in Certificate of Title, Volume 674, folio 239, Auckland Registry.
(12) All that piece of land containing 568 acres 3 roods 0·6 perches, more or less, being parts of the block situated in Block XIV of the Maungatautari Survey District called Wharepuhunga No. 14B, parts of the said land being part of Lot 6 on a plan deposited in the Land Registry Office at Auckland under No. 7303, and being the whole of the land in Certificate of Title, Volume 674, folio 272, Auckland Registry.
(13) All that piece of land containing 384 acres 2 roods 14 perches, being Lot 1 on a plan deposited in the Land Registry Office at Auckland under No. 13756, being portion of Pukekura No. 15, No. 16, and No. 17 Blocks, situated in the Maungatautari Survey District, and being the whole of the land comprised in Certificate of Title, Volume 316, folio 335, Auckland Registry.
