The Samoa Anglican Church Lands Order, 1937.

ORDER IN COUNCIL.
At the Government House at Wellington, this 18th day of May, 1937.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the land described in the Schedule hereto is land in Western Samoa belonging to the Church of England: And whereas such land has been granted or acquired and is now registered in the Land Register of Western Samoa in Volume 2, folio 201, in the name of Leonard Stanley Kempthorne, Bishop of the Church of England in Polynesia: And whereas the said Leonard Stanley Kempthorne holds such land as trustee for the said Church: And whereas it is expedient that such land should be vested in the Bishop of the Church of England in Polynesia for the time being as a corporation sole, and that the said corporation sole should have power to acquire other lands hereafter: And whereas legislation is necessary to enable such lands to be so vested:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of that Dominion, and in pursuance of the authority to make regulations for the peace, order, and good government of Samoa conferred upon him by the Samoa Act, 1921, and of all other powers and authorities enabling him in that behalf, doth hereby order as follows:—

These regulations may be cited as the Samoa Anglican Church Lands Order, 1937, and shall come into force on the first day of June, one thousand nine hundred and thirty-seven.

The freehold land described in the Schedule hereto which belongs to the Church of England, and which is registered in the Land Register of Western Samoa in the name of Leonard Stanley Kempthorne, shall vest in and be held by the Bishop of the Church of England in Polynesia for the time being and his successors for ever in perpetual succession as a corporation sole, according to the tenure thereof, subject, nevertheless, to all such encumbrances and other interests, if any, as the same is now subject to, and subject to the trusts and purposes for which such lands may have been granted or acquired.

If any lands in Samoa are hereafter granted to or acquired by the Bishop of the Church of England in Polynesia for the time being, whether in his personal name or by the title of the corporation sole created by this Order, and the instrument of assurance under which they are granted or acquired contains a provision to the effect that this Order is intended to apply to such lands, then such lands shall vest in and be held by the said Bishop as a corporation sole by virtue of this Order according to the tenure thereof, subject, nevertheless, to the trusts and purposes for which such lands may be granted or acquired.
