Order in Council authorizing the Borrowing by the Blenheim Borough Council by way of Hypothecation of Debentures issued in respect of a Loan of £3,000.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 7th day of May, 1937.
Present:
THE HON. P. FRASER PRESIDING IN COUNCIL.
WHEREAS by Order in Council made on the seventh day of May, one thousand nine hundred and thirty-seven, consent was given to the raising in New Zealand by the Blenheim Borough Council (hereinafter called “the said local authority”) of the sum of three thousand pounds (£3,000) by a loan to be known as “Additional Abattoir Loan, 1937” (hereinafter called “the said loan”), such consent being given subject to the determinations as to borrowing and repayment therein set out, including, inter alia, the provision that the rate of interest that might be paid in respect of the said loan or any part thereof should be such as should not produce to the lender or lenders a rate or rates exceeding three pounds ten shillings (£3 10s.) per centum per annum:
And whereas the said local authority, pending the raising of the said loan in accordance with the said determinations, is desirous of borrowing the said sum or part thereof by hypothecation or mortgage pursuant to section thirty-four of the Local Bodies’ Loans Act, 1933, of the debentures authorized to be issued in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section seven of the Local Authorities Interest Reduction and Loans Conversion Act, 1932–33, and by section eight of the Local Authorities Interest Reduction and Loans Conversion Amendment Act, 1933, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the said local authority, pending the raising of the said loan in accordance with the said determinations, borrowing the said sum of three thousand pounds (£3,000) or any part thereof by the hypothecation or mortgage of the said debentures at a rate of interest not exceeding four pounds ten shillings (£4 10s.) per centum per annum, and hereby prescribes that the money borrowed by the hypothecation or mortgage of the said debentures shall, pending the raising of the said loan, be repaid by annual amounts equivalent to the instalments of principal which would have been repaid if on the first date on which any moneys are borrowed by such hypothecation or mortgage the whole of the said loan of three thousand pounds (£3,000) had been raised on the terms prescribed by the Order in Council made on the seventh day of May, one thousand nine hundred and thirty-seven.

Validating Proceedings in connection with the Stratford Borough Council’s Loans of £5,000 and £3,500.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 7th day of May, 1937.
Present:
THE HON. P. FRASER PRESIDING IN COUNCIL.
WHEREAS the Stratford Borough Council lately proceeded to raise loans of five thousand pounds (£5,000) and three thousand five hundred pounds (£3,500) under the Local Bodies’ Loans Act, 1926 (hereinafter called “the said Act”), to be known as “Electrical Works Extension Loan, 1936,” and “Public Baths Loan, 1936,” respectively (hereinafter called “the said loans”):
And whereas the proceedings in connection with each of the said loans were irregular or defective in that the public notice published pursuant to section ten of the said Act in respect of such loan did not in the first three of the four publications of such public notice prescribed by the said section contain a statement that it was proposed to pay out of the loan the cost of raising the same:
And whereas it appears that the ratepayers of the district have not been misled by the said irregularity or defect as aforesaid, and it is expedient to validate the same:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and twenty-two of the said Act, and of all other powers and authorities enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings in connection with each of the said loans shall be valid to all intents and purposes as though the aforesaid public notice in respect of such loan in each of the said first three publications had contained a statement that it was proposed to pay out of the loan the cost of raising the loan, and that the validity of the proceedings in connection with each of the said loans or the validity of the security for each of the said loans shall not be called in question by reason only of the irregularity or defect aforesaid.

Authorizing the Laying-off of a Street (Lisava Avenue) in the Borough of Timaru of a Width less than 66 ft., but not less than 49 ft. 6 in., subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 7th day of May, 1937.
Present:
THE HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, the Municipal Corporations Act, 1933, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Timaru Borough Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet, but not less than forty-nine feet six inches, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said street within a distance of thirty-five feet from the centre-line of the said street.
SCHEDULE.
THAT proposed street in the Canterbury Land District, Borough of Timaru, containing by admeasurement 1 rood 20·4 perches, more or less, being portion of Lot 9, D.P. 1, being part Rural Section 1652. As the same is more particularly delineated on the plan marked P.W.D. 94067, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
