Notice prohibiting the Sale in the Borough of New Plymouth
of certain Goods comprised in the Trade of a Tobacconist
under the Shops and Offices Act, 1921–22.
WHEREAS a petition in writing, signed by a majority
of the occupiers of all the tobacconists’ shops within
the Borough of New Plymouth, has been forwarded to me
desiring that the sale of certain goods comprised in the trade
of a tobacconist—namely, smoking requisites—be prohibited
during such times as the said shops are required to be closed
in pursuance of the Shops and Offices Act, 1921–22 :
And whereas I, Hubert Thomas Armstrong, Minister of
Labour, am satisfied that the sale of the said goods is com-
prised in the trade of a tobacconist in the said district, and
that the signatures to such petition represent a majority of
the occupiers of all the said shops in the said district :
Now, therefore, in pursuance of section 33 of the said Act,
I do hereby direct that on and after the 7th day of December,
1936, the sale of the said goods in the Borough of New
Plymouth shall be and is hereby prohibited as follows : On
Mondays, Tuesdays, and Thursdays after the hour of 5.30 p.m.,
on Wednesdays and Fridays after the hour of 9.30 p.m., and
on Saturdays after the hour of 8 p.m., with the following
exception—On the working-day that first precedes any of
the special days mentioned in or coming within the meaning
of section 26 of the Shops and Offices Act, 1921–22, from the
18th December to 7th January, and from the Monday preceding
Good Friday and up to the end of the week following Good
Friday, the sale of the said goods is not prohibited :
The notice gazetted on the 18th April, 1935, prohibiting
the sale in the Borough of New Plymouth of certain goods
comprised in the trade of a tobacconist shall be and is hereby
cancelled as from the date of the coming into operation of
this notice.

Declaring the Carriage of Passengers by Motor-vehicle to
constitute a Passenger-service in certain Cases.
PURSUANT to section 16 of the Transport Licensing
Amendment Act, 1936, I, Robert Semple, Minister of
Transport, do hereby declare that during any time while a
ship, in use chiefly for the transport of tourists on cruising
tours, is in the Auckland Harbour any service by a motor-
vehicle for the carriage for hire or reward of passengers from
any place within the Auckland Transport District to any
place outside a radius of seventy-five miles from the Chief
Post Office at Auckland shall be deemed for the purposes of
the Transport Licensing Act, 1931, to be a passenger-service
within the meaning of the said Act.
