Order in Council varying certain of the Determinations in respect of the Egmont County Council's Loan of £5,600.

ORDER IN COUNCIL.
At the Government House at Wellington, this 5th day of August, 1936.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council made on the fourteenth day of July, one thousand nine hundred and thirty-six, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Egmont County Council (hereinafter called “the said local authority”) of the sum of five thousand six hundred pounds (£5,600) by a loan to be known as “Flood-damage Loan, 1936” (hereinafter called “the said loan”):
And whereas the said loan has not yet been raised, and it is expedient to vary certain of the determinations in respect thereof:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations as follows:—
(1) In lieu of providing for repayment of the said loan at the end of twenty (20) years the said local authority shall provide for repayment thereof by the annual redemption of debentures in the years set out in the first column of the Schedule hereunder of the amounts set out in the second column of the said Schedule.
(2) In lieu of establishing a sinking fund in respect of the said loan, the repayments referred to in clause one (1) hereof shall be made from the revenue of the said local authority to the extent set out in the third column of the said Schedule.

Variation of Order in Council prohibiting Alienation of Native Land.

ORDER IN COUNCIL.
At the Government House at Wellington, this 5th day of August, 1936.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
PURSUANT to section four hundred and forty-two of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary an Order in Council made on the fourteenth day of March, one thousand nine hundred and thirty-two, and published in the Gazette on the seventeenth day of March, one thousand nine hundred and thirty-two, at page 547, and affecting Awaawakino A and other blocks by excluding therefrom the land described in the Schedule hereto.

Extending Time for holding Election to fill Extraordinary Vacancy on Tauranga Borough Council.

At the Government Buildings at Wellington, this 12th day of August, 1936.

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
WHEREAS by a resignation under section forty-three of the Municipal Corporations Act, 1933, an extraordinary vacancy occurred in the office of a councillor of the Borough of Tauranga:
And whereas an election to fill such extraordinary vacancy should have been held within the period prescribed by section forty-two of the Local Elections and Polls Act, 1925:
And whereas it is deemed expedient to extend the time for the holding of such election:
Now, therefore, His Excellency the Governor-General, in pursuance and exercise of the powers and authorities vested in him by section seventy-one of the Local Elections and Polls Act, 1925, and of all other powers enabling him in this behalf, and acting by and with the advice and consent of the Executive Council, doth hereby extend the time for holding the aforesaid election of a councillor of the Borough of Tauranga; and doth hereby order and declare that an election to fill the vacancy aforesaid shall be held and take place on Wednesday, the sixteenth day of September, one thousand nine hundred and thirty-six.

The South-eastern Side of Portion of Havelock Street, in the Borough of Birkenhead, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 5th day of August, 1936.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Birkenhead Borough Council on the seventeenth day of June, one thousand nine hundred and thirty-six, viz.:—
“The Birkenhead Borough Council, being the local authority having control of the streets in the Borough of Birkenhead, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Havelock Street adjoining Lot 31 of Allotment 60, Takapuna Parish”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Havelock Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE south-eastern side of all that portion of street, situated in the North Auckland Land District, Borough of Birkenhead, known as Havelock Street, fronting Lot 31 of Allotment 60, Takapuna Parish. As the same is more particularly delineated on the plan marked P.W.D. 92809, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
