Amending Regulations under the National Provident Fund Act, 1926.

ORDER IN COUNCIL.
At the Government House at Wellington, this 12th day of June, 1936.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
I N pursuance and exercise of the powers conferred upon him by the National Provident Fund Act, 1926, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the consent of the Executive Council of the said Dominion, doth hereby make the following regulations for the purposes of that Act, and doth further declare that the amendment hereby made shall take effect on the first day of June, one thousand nine hundred and thirty-six.
REGULATIONS.

These regulations may be cited as the National Provident Fund Regulations Amendment, 1936.

These regulations shall be read with and deemed to form part of the National Provident Fund Regulations, 1927 (hereinafter called “the principal regulations”).

Regulation 3 of the principal regulations is amended by adding thereto the following additional clauses:—
“ (8) An account, to be called the Investment Fluctuation Reserve, shall be raised out of the general revenue of the fund by debiting in the Revenue Account and crediting to the Investment Fluctuation Reserve such sums as the Board may from time to time direct.
“ (9) All losses upon realization of investments shall be charged against the Investment Fluctuation Reserve so far as the same extends.”
- Form No. 1 in the First Schedule to the principal regulations is amended by inserting in the form of Revenue Account immediately before the line “Other outgo (to be specified),” the following additional line:—
“ Investment Fluctuation Account.”
- Form No. 1 in the First Schedule to the principal regulations is further amended by inserting in the form of balance-sheet immediately following the line “ Fund as per Revenue Account,” the following additional line:—
“ Investment Fluctuation Reserve.”

Cook Islands Pearl-shell Fisheries Regulations Amendment, 1936.

B Y virtue of the Cook Islands Act, 1915, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.
REGULATIONS.

These regulations may be cited as the Cook Islands Pearl-shell Fisheries Regulations Amendment, 1936.

These regulations shall be read together with and form part of the Cook Islands Pearl-shell Fisheries Regulations, 1921 (hereinafter referred to as “the principal regulations”), and the amendments thereof.

These regulations shall come into force on the date of the publication hereof in the New Zealand Gazette.

Regulations numbers 6 and 7 of the Cook Islands Pearl-shell Fisheries Regulations Amendment, 1930, and the whole of the Cook Islands Pearl-shell Fisheries Regulations Amendment, 1932, are hereby revoked.

Notwithstanding anything contained in the principal regulations, fishing for pearl-shell by means of diving-machines shall be permitted in both the northern reserve of Penrhyn and the southern reserve of Penrhyn from the date of the coming into force of this Order in Council until the 31st day of December, 1937, but shall thereafter only be permitted during the times set out in clause 8 of the principal regulations.

Fishing for pipi pearls by means of diving-machines shall be permitted in both the northern reserve of Penrhyn and the southern reserve of Penrhyn from the date of the coming into force of this Order in Council until the 31st day of December, 1937:
Provided, however, that only diving-machines which are for the time being licensed pursuant to the provisions of Part III of the principal regulations shall be permitted to fish for pipi pearls. No additional fee shall be payable.
