Amending Regulations under Health Act as to bottling of Milk.

GALWAY, Governor-General.
ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 3rd day of June, 1936.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by section one hundred and thirty-two of the Health Act, 1920, and of all other powers enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the regulations made under the said Act on the seventh day of June, one thousand nine hundred and thirty-five, and published in the Gazette on the twentieth day of the same month, at page 1728, as follows:—

  1. By adding to clause (e) of Regulation 12 the following: “Provided further that, subject to the approval of the Medical Officer of Health, an alternative method of sterilization by means of chlorine compounds may be used on condition that the process is wholly mechanically effected, that no residual chlorine compound remains in any bottle at the completion of the process, and that the process ensures a residual bacterial plate count of not more than one per c.c. of bottle capacity.”

  2. By inserting the following additional clause:—

“12D. (a) No person shall have in his possession or in or about his premises ready for filling with milk any bottle which has not been sterilized in accordance with these regulations.

“(b) Any Inspector or any officer under the Sale of Food and Drugs Act shall have access at all reasonable times to any premises where a process of sterilizing milk-bottles is carried on, and such Inspector or officer may select and take away for examination or testing any bottle or bottles which have undergone a sterilization process, and such Inspector or officer shall be empowered to do such other things, or to require such demonstrations as he may deem fit and necessary, in order to test the efficiency of the sterilizing process used on the premises.

“(c) Any person by whose act, default, sufferance, or use or operation of any process of sterilization permitted by these regulations the required sterility is not secured shall be deemed to have contravened the regulations.”

Additional Regulations for Perch-fishing in the Wellington Acclimatization District.

At the Government Buildings at Wellington, this 3rd day of June, 1936.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS by Orders in Council dated the thirty-first day of August, one thousand nine hundred and thirty-one, and the twentieth day of August, one thousand nine hundred and thirty-five, and published in the Gazette of the third day of September, one thousand nine hundred and thirty-one, at page 2534, and the twenty-second day of August, one thousand nine hundred and thirty-five, at page 2338, respectively, regulations were made for trout and perch fishing in the Wellington Acclimatization District (hereinafter referred to as “the principal regulations”):

And whereas it is desirable to make additional regulations for perch-fishing in the said acclimatization district:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in him by the Fisheries Act, 1908, and its amendments, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations.

REGULATIONS.

  1. Notwithstanding anything contained in the principal regulations, licenses to fish for perch only in the waters within the said district may be issued under the hand of the secretary of the Wellington Acclimatization Society, or by any one authorized by the said secretary in that behalf; and such license shall entitle the person named therein to fish for perch in the said district in any one year from the 1st day of June to the 31st day of August, inclusive, subject to the following regulations:—

  2. The fee to be charged for a license as aforesaid shall be 5s., and shall be in such form as may be prescribed by the said secretary.

  3. The holder of such a license may fish for perch with one rod and line only, but a landing-net or gaff may be used to secure any perch taken with such rod and line.

  4. Any person who, while fishing for perch pursuant to the license issued to him under these regulations, takes a trout or any acclimatized fish other than perch shall immediately return the same to the waters whence it was taken.

  5. No license shall authorize any person other than the person named therein to fish.

  6. No person shall fish for perch without a license; and every person fishing shall, on demand of any ranger, constable, officer of the said society, or of any person producing a license issued pursuant to these regulations, produce and show to such ranger, officer, or person his license and the contents of his creel or bag.

  7. No person shall buy, sell, or expose or offer perch for sale, or shall fish for the purpose of obtaining perch for sale.

  8. If any person shall be convicted of an offence against these regulations his license (if any) held by the offender shall thereupon become void.

  9. Nothing in the principal regulations shall apply to licenses issued pursuant to these regulations.

  10. The penalty for the breach of any of these regulations shall be not less than £2 nor more than £50.

Consenting to the Assignment to W. Guildford Todd, Medical Practitioner, of Rotherham, by Neil Gordon McLean, Medical Practitioner, formerly of Rotherham, of his Rights, Powers, and Privileges under an Order in Council dated the 10th July, 1933.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 3rd day of June, 1936.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and of any other power in anywise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the assignment to W. Guildford Todd, Medical Practitioner, of Rotherham, by Neil Gordon McLean, Medical Practitioner, formerly of Rotherham, of his rights, powers, and privileges under an Order in Council dated the tenth day of July, one thousand nine hundred and thirty-three, and published in the New Zealand Gazette No. 50 of the thirteenth day of the same month, authorizing Frederick Rich Smale, Medical Practitioner, and Harry Maurice Crosslegh Dampier-Crossley, Farmer, both of Rotherham, jointly to use water for the purpose of generating electricity, and to erect and use electric lines, which rights, powers, and privileges were previously assigned by the said Frederick Rich Smale to the said Neil Gordon McLean; provided that nothing herein contained shall affect the rights, powers, and privileges by the said license conferred on the said Harry Maurice Crosslegh Dampier-Crossley.
