The South-western Side of Portion of Bayfield Road, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 13th day of May, 1936.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

I N pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the fourteenth day of April, one thousand nine hundred and thirty-six, viz.:—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the south-western side of Bayfield Road, in the said City of Dunedin, where such portion of street abuts on parts Sections 1 and 9 and 182R, Block III, Anderson’s Bay Survey District, as the said portion of street is more particularly shown on the plan annexed hereto and is thereon coloured brown and edged with red to its centre-line ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Bayfield Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Bayfield Road, fronting parts Sections 1, 9, and 182R, Block III, Anderson’s Bay Survey District. As the same is more particularly delineated on the plan marked P.W.D. 92097, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Appointing a Member of the Foxton Harbour Board.

GALWAY, Governor-General.

W HEREAS it is provided by subsection three of section thirty-eight of the Harbours Act, 1923, that in the event of an extraordinary vacancy in the office of a non-elective member of a Harbour Board, the Governor-General shall, by Warrant under his hand, appoint some qualified person in his place:

And whereas Francis Campbell Raikes, a non-elective member of the Foxton Harbour Board, is deceased, and an extraordinary vacancy in the membership of the Board has been created, and it is desirable to appoint a qualified person in his place:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the hereinbefore-recited power and authority doth hereby appoint

Mark Perreau

to be a member of the Foxton Harbour Board in the place of the said Francis Campbell Raikes, deceased.

As witness the hand of His Excellency the Governor-General, this 12th day of May, 1936.

Officer authorized to take and receive Statutory Declarations.

P URSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, George Vere Arundell, Viscount Galway, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that Hugh Goldsbury, being an officer in the service of the Crown holding the office of Head Teacher, Native School, at Omaio, is authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.

As witness the hand of His Excellency the Governor-General, this 11th day of May, 1936.

Exempting Crown Lands from the Provisions of the Mining Act, 1926.

GALWAY, Governor-General.

W HEREAS by section twenty of the Mining Act, 1926, it is, inter alia, enacted that the Governor-General may from time to time by notice in the Gazette exempt any Crown land from mining, or from any specified mining purpose, or from that Act, or any specified provisions of that Act; and that the lands to which any such notice relates shall be specified therein by words of particular description:

And whereas it is desirable that the Crown land specified in the Schedule hereto shall be exempted from the provisions of the Mining Act, 1926, and its amendments:

Now, therefore, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by section twenty of the Mining Act, 1926, and of all other powers and authorities in anywise enabling me in that behalf, do hereby exempt the land particularly described in the Schedule hereto from the provisions of the Mining Act, 1926, and do also hereby declare that such exemption shall take effect from the date of publication of this notice in the Gazette.

SCHEDULE.

ALL that area of land in the Nelson Land District, containing 98 acres 1 rood, more or less, being Section 20 (portion original 8), Block V, Waitapu Survey District. As the same is more particularly delineated on the plan numbered N. 6/4/45, deposited in the Head Office of the Mines Department at Wellington, and thereon coloured red.

As witness the hand of His Excellency the Governor-General, this 13th day of May, 1936.
