Authorizing the Laying-off of a Street in the City of Auckland
of a Width of less than 66 ft., subject to a Condition as to the
Building-line.

GALWAY, Governor-General.
ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 7th day of
February, 1936.

Present:

THE HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers vested in him by
the Municipal Corporations Act, 1933, and the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby authorize the Auckland City Council to permit the
laying-off of the proposed street, described in the Schedule
hereto, of a width of less than sixty-six feet, subject to the
condition that no building or part of a building shall at any
time be erected on the land fronting the said street within a
distance of thirty-three feet from the centre-line of the said
street.

SCHEDULE.

THAT proposed street, in the North Auckland Land District,
City of Auckland, containing by admeasurement 1 rood
34 perches, more or less, being portion of parts Allotments 4,
5, and 6 of Section 15, Suburbs of Auckland. As the same is
more particularly delineated on the plan marked P.W.D. 90413,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

The North-eastern Side of Portion of City Road and
the South-western and South-eastern Sides of Portions
of Erin Street, in the City of Dunedin, exempted from
the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-
line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 13th
day of May, 1936.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred
by the Public Works Act, 1928, and of all other
powers in anywise enabling him in this behalf, His
Excellency the Governor-General of the Dominion of
New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth
hereby approve of the following resolution passed by
the Dunedin City Council on the ninth day of December,
one thousand nine hundred and thirty-five, viz.:

"That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets in the said City of Dunedin, viz.,—

"(a) Portion of the north-eastern side of City Road abutting on Allotments 24 and 25, Township of Kaikorai, being also part of Section 24, Block IV, Upper Kaikorai Survey District; and

"(b) Portions of the south-western and south-eastern sides of Erin Street abutting on Allotments 24 and 25, Township of Kaikorai, being also part of Section 24, Block IV, Upper Kaikorai Survey District;

as the said portions of streets are more particularly shown on the plan annexed hereto and are thereon coloured red to their centre-lines;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of City Road or the south-western and south-eastern sides of the portions of Erin Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE north-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as City Road, fronting Allotments 24 and 25, Township of Kaikorai, being part Section 24, Block IV, Upper Kaikorai Survey District.

Also the south-western and south-eastern sides of all those portions of street situated in the said land district and city, known as Erin Street, fronting Allotments 24 and 25, Township of Kaikorai, being part Section 24, Block IV, Upper Kaikorai Survey District.

As the same are more particularly delineated on the plan marked P.W.D. 92075, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Albion Road and the
North-eastern Side of Portion of Every Street, in the City of
Dunedin, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to the
Building-line.

"(a) Portion of the south-eastern side of Albion Road abutting on Lots 37–51, Township of Shiel Hill, and part Section 2, Block VII, Anderson’s Bay District; and

"(b) Portion of the north-eastern side of Every Street abutting on Lot 37, Township of Shiel Hill, and part Section 2, Block VII, Anderson’s Bay District;

as the said portions of streets are more particularly shown on the plan annexed hereto and are thereon coloured brown and edged with red to their centre-lines ";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Albion Road or the north-eastern side of the portion of Every Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE south-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Albion Road, fronting Lots 37 to 51, inclusive, Township of Shiel Hill, and part Section 2, Block VII, Anderson’s Bay District.

Also the north-eastern side of all that portion of street situated in the said land district and city, known as Every Street, fronting Lot 37, Township of Shiel Hill, and part Section 2, Block VII, Anderson’s Bay District.

As the same are more particularly delineated on the plan marked P.W.D. 92098, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.
