“(b) That portion of road abutting on Sections 44, 45,
and closed road, Lower Harbour West Survey
District—the said portion of road is more parti-
cularly shown on the plan annexed hereto and
thereon coloured red ;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the portions
of roads (described in the Schedule hereto) within a distance
of thirty-three feet from the centre-lines of the said portions
of roads.

SCHEDULE.

THE northern side generally of all that portion of road situated
in the Otago Land District, County of Waikouaiti, fronting
Sections 39, 40, 41, 42, 43, and 50, and closed road, Block I,
Lower Harbour West Survey District ; marked A–B on plan.

Also the western side of all that portion of road situated
in the said land district and county, fronting parts of Sec-
tions 44 and 45, and closed roads, Block I, Lower Harbour
West Survey District ; marked C–D on plan.

Also the eastern side of all that portion of road situated in
the said land district and county, fronting parts of Sections 44
and 45, and closed road, Block I, Lower Harbour West Survey
District ; marked E–F on plan.

As the same are more particularly delineated on the plan
marked P.W.D. 91684, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

The North-eastern Side of Portion of a Road in the County of Waitaki exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 22nd day of April, 1936.

Present :

THE HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitaki County Council on the twenty-eighth day of February, one thousand nine hundred and thirty-six, viz. :—

“ The Waitaki County Council, being the local authority having control of the roads within the County of Waitaki, hereby resolves pursuant to the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, that the provisions of that section shall not apply to that side of that portion of the road within the said county abutting on the south-western boundary of part Section 47, Block II, Papakaio Survey District, which is included in Lot 4 on plan deposited in the Lands Registry Office at Dunedin as No. 3308 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE north-eastern side of all that portion of road, situated in the Otago Land District, County of Waitaki, fronting part Section 47, Block II, Papakaio Survey District, being part of Lot 4, D.P. 3308. As the same is more particularly delineated on the plan marked P.W.D. 91861, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown.

The North-eastern Side of Portion of Hornbrook Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 22nd day of April, 1936.

Present :

THE HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the thirtieth day of September, one thousand nine hundred and thirty-five, viz. :—

“ The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, hereby by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portion of the north side of Hornbrook Street abutting on the land comprised in Certificates of Title, Volume 107/226 and Volume 81/79 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Hornbrook Street (described in the Schedule hereto) within a distance of forty-eight feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-eastern side of all that portion of street, situated in the Canterbury Land District, City of Christchurch, known as Hornbrook Street, fronting part Rural Section 48A. As the same is more particularly delineated on the plan marked P.W.D. 91682, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

At the Government Buildings at Wellington, this 22nd day of April, 1936.

Present :

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the sixteenth day of March, one thousand nine hundred and thirty-six, viz. :—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the north-western side of Bay View Road, in the said City of Dunedin, where such portion of street abuts on Allotment 22 and part Allotment 23, Block VIII, Township of South Dunedin, as the said portion of street is more particularly shown on the plan annexed hereto and is thereon coloured brown and edged with red to its centre-line ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Bay View Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
