Order in Council under Section 118 of the Government Railways Act, 1926.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 8th day of January, 1936.
Present :
THE HON. M. J. SAVAGE PRESIDING IN COUNCIL.
WHEREAS Victor Robert John Stanley, of Wellington, is exclusively engaged as General Secretary of the New Zealand Railway Officers’ Institute :
And whereas, prior to being engaged as aforesaid, the said Victor Robert John Stanley was in the service of the New Zealand Government Railways Department, and in respect of such service was a contributor to the Government Railways Superannuation Fund :
And whereas the period of engagement of the said Victor Robert John Stanley as General Secretary of the said Institute has been continuous with his aforementioned period of service in the Government Railways Department :
And whereas the rate of contribution paid by the said Victor Robert John Stanley to the Government Railways Superannuation Fund when a contributor thereto in respect of his aforesaid period of service in the Department was three per centum of the salary or wage then received by him :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred on him by section one hundred and eighteen of the Government Railways Act, 1926, and of every other power and authority enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare and order that from and including the twenty-sixth day of October, one thousand nine hundred and thirty-five, the said Victor Robert John Stanley shall have and be deemed to have had all the rights, privileges, and liabilities to which a contributor to the Government Railways Superannuation Fund is entitled or subject under the provisions of Part III of the Government Railways Act, 1926, subject, however, to the provisions of the said section one hundred and eighteen of the said Act, and to the following express conditions, namely :—

The contribution of the said Victor Robert John Stanley to the Government Railways Superannuation Fund shall be at the rate of three per centum of the salary paid to him by the New Zealand Railway Officers’ Institute ; and such contribution shall, as from and including the twenty-sixth day of October, one thousand nine hundred and thirty-five, be paid to that fund at such time or times and by such instalments as the Government Railways Board may determine.

In addition to the contribution payable by the said Victor Robert John Stanley, as specified in the last preceding paragraph hereof, there shall be paid to the fund by the New Zealand Railway Officers’ Institute at such times and in such manner (whether by instalments or otherwise) as may be determined by the Government Railways Board, a sum which in each year shall bear the same proportion to the total amount payable by the said Victor Robert John Stanley by way of contribution to the fund in respect of such year as the total sum paid by the New Zealand Government Railways Department to the fund by way of subsidy bears to the aggregate of the sums paid into the fund by contributors under the Government Railways Act, 1926, in such year.

Prohibiting the Importation of Insects, &c.—(C. No. 149.)

IN pursuance and exercise of the powers and authorities conferred upon him by section forty-six of the Customs Act, 1913, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prohibit the importation into New Zealand, save with the consent of the Minister of Internal Affairs, of insects, including the eggs of insects and insects in their larval, pupal, and adult stages, and of spiders and scorpions and the eggs of spiders and scorpions.

Post and Telegraph Officers’ Sick-benefit Fund : Regulations.

PURSUANT to section twenty-six of the Finance Act, 1935 (No. 2), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.
REGULATIONS.
PRELIMINARY.

These regulations may be cited as the Post and Telegraph Officers’ Sick-benefit Regulations.

In these regulations, if not inconsistent with the context,—
“The said Act” means section 26 of the Finance Act, 1935 (No. 2) :
“Minister” means the Postmaster-General :
“The fund” means the fund established by the said Act, and includes the accumulations thereof and all investments of the fund from time to time for the time being :
“Officer” means a permanent officer of the Post and Telegraph Department whose leave is reduced pursuant to the said Act :
“Salary” for purposes of computation of benefits from the fund means the rate of salary or wages paid in respect of service to an officer on the 31st day of March immediately preceding the time in respect of which any benefit is to be computed, including a lodging-allowance normally continued during sick-leave, married officer’s allowance, and allowances paid under item (a) of Regulation 65 of the regulations relating to the Post and Telegraph Department made on the 14th day of December, 1925, but does not include other payments and allowances referred to in Regulations 58 to 68 of the last-mentioned regulations :
“Trustees” means the trustees for the time being of the fund appointed as hereinafter provided.
- The date as from which the leave to which each officer would otherwise be entitled shall be reduced as provided by the said Act shall be the 8th day of January, 1936.
APPOINTMENT OF TRUSTEES.
- The persons by whom the fund shall be administered shall be three trustees appointed as under :—
(i) One person being a member of the staff of the Post and Telegraph Department to be appointed by the Minister at his discretion ;
(ii) One person to be appointed by the Minister on the nomination of the Post and Telegraph Officers’ Guild, Incorporated ;
(iii) One person to be appointed by the Minister on the nomination of the Post and Telegraph Employees’ Association, Incorporated.

Each appointment shall be for such term as the Minister thinks fit not exceeding three years from the date of appointment.

Any trustee may by notice in writing to the Minister resign his position or may be removed by the Minister if he thinks such action expedient or necessary to the proper administration of the fund.

Upon any vacancy in the position of a trustee caused by death, resignation, or removal, the Minister shall at his discretion or upon nomination as the case may require appoint a person to fill such vacancy for the remainder of the term of the person originally appointed.

Upon the expiration of any term of appointment the person whose term has expired shall be eligible for reappointment, subject (if the case so requires) to his being again nominated as aforesaid.
MEETINGS OF TRUSTEES.

At every meeting of the trustees the member of the staff of the Post and Telegraph Department appointed by the Minister at his discretion shall, if present, be chairman ; in his absence the substitute appointed under Regulation 11 hereof shall be chairman.

The Minister may at any time in his discretion appoint any person to act from time to time in the place of any respective trustee who may be incapacitated by reason of illness, absence, or other cause from acting in the execution of the powers hereby conferred on the trustees, and the provisions
