Amending the General Fisheries Regulations prohibiting Trawling in Kaipara Harbour and permitting the use of Groyne for Whitebait-fishing in the Avon River.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

P URSUANT to the provisions of the Fisheries Act, 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby amend Regulation 135 (5) of the General Fisheries Regulations of the twenty-ninth day of June, one thousand nine hundred and thirty-two, and published in the Gazette of the seventh day of the following month, at page 1598, and Regulation 10 (a) of the Whitebait Regulations, dated the twenty-sixth day of September, one thousand nine hundred and thirty-two, and published in the Gazette of the sixth day of October, one thousand nine hundred and thirty-two, at page 2086, in the manner set forth in the Schedule hereto.

SCHEDULE.

REGULATION 135 (5) of the 29th day of June, 1932, is hereby repealed, and the following regulation is substituted in lieu thereof:—

“ 135. (5) Kaipara Harbour inside a straight line drawn from the outer end of North Sandspit (otherwise known as Dry Spit) to Puki-tu.”

Regulation 10 (a) of the Whitebait Regulations, dated the 26th day of September, 1932, is hereby further amended by the addition of the following proviso :—

“ 10. (a) Provided further that it shall be lawful to erect a fence of brushwood of a total length of not more than ten feet for use in fishing for whitebait in that part of the Avon River which is below the Brighton Tramway Bridge; provided that no person shall erect such fence within one hundred yards of the said bridge.”

Exempting Crown Land in the Westland Land District from the Operation of Part III of the Coal-mines Act, 1925.

GALWAY, Governor-General.

I N pursuance and exercise of the powers and authorities conferred upon me by subsection two of section one hundred and seventy-one of the Coal-mines Act, 1925, and of all other powers and authorities enabling me in this behalf, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby declare that the land described in the Schedule hereto shall be exempt from the operation of Part III of the Coal-mines Act, 1925, and do hereby further declare that this notice shall take effect as from the date of the gazetting hereof.

SCHEDULE.

ALL that area in the Westland Land District, containing 18 acres 1 rood 18 perches, more or less, being portion of Crown land set apart for the purposes of Part II of the Coal-mines Act, 1905 (Gazette, 1907, page 27), and situated in Block I, Cobden Survey District (Westland R.D.) (S.O. 3148). As the same is more particularly delineated on the plan numbered N. 6/4/17, deposited in the Head Office of the Mines Department at Wellington.

As witness the hand of His Excellency the Governor-General, this 24th day of October, 1935.

COMMAND AND STAFF.

The period of command of Lieutenant-Colonel H. B. Maunsell, E.D., the Wellington East Coast Mounted Rifles, is extended to 31st May, 1936.

Captain (local Major) A. J. Edney, R.E., to be Staff Officer (Fortifications and Works), and remains attached to the General Staff for Engineer Duties. Dated 9th October, 1935.

Captain G. H. Clifton, M.C., N.Z. Staff Corps, having returned to the Dominion after completion of a tour of instruction in England, ceases to be seconded, and is appointed General Staff Officer (Intelligence), G.H.Q., Wellington. Dated 9th October, 1935.

Captain C. S. J. Duff, Regiment of Royal N.Z. Artillery, having returned to the Dominion after completion of a tour of instruction in England, ceases to be seconded, and is appointed Assistant Staff Officer, Artillery (temp.), G.H.Q., Wellington. Dated 15th October, 1935.

Captain S. F. Allen, N.Z. Staff Corps, relinquishes the appointment of Assistant General Staff Officer (Intelligence) (temp.). Dated 9th October, 1935.
