(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.

(3) In lieu of making provision for the repayment of the said sum by establishing a sinking fund in respect thereof, the said local authority shall repay the said sum by equal aggregate annual or half-yearly instalments including principal and interest extending over a period of thirty (30) years from the first day of April, one thousand nine hundred and thirty-five.

(4) The payment of such instalments shall be made in New Zealand, and no such instalment shall be paid out of loan-money.

(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said sum or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Vesting the Control of Scenic Reserves in the Papatoawai Scenic Board.


BLEDISLOE, Governor-General.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserves described in the Schedule hereto (being lands reserved under the said Act) for the period of five years from the date hereof (unless previously altered or revoked under the said Act) in the undermentioned persons, namely,—

Francis Adams,
Claude Gaudin Martin,
Innis McKay,
William Frederick McCombe,
Kenneth Ross,
Charles Stuart Shanks, and
William Wells,

who are hereby constituted for that purpose a special Board by the name of the Papatoawai Scenic Board (herein referred to as “the Board”), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say,—

  1. The first meeting of the Board shall be held on Saturday, the second day of March, one thousand nine hundred and thirty-five, at eight o’clock p.m., in the Papatoawai School, and thereafter the Board shall meet for the transaction of business on the first Saturday in each quarter at the time and place aforesaid, or at such other time or place as may from time to time be fixed by the Board.

  2. The members of the Board shall at their first meeting and thereafter at the annual meeting hereinafter mentioned elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  3. Special meetings may be convened by the Chairman, provided that two days’ notice of such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  4. Any four members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  5. All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman for such meeting.

  7. If, by resignation, death, incapacity, or otherwise, the seat of any member shall be or become vacant, or if any member absents himself, without reasonable cause, from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

  8. The Board shall prepare and submit at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister in Charge of Scenery Preservation as soon as possible after each annual meeting.

  9. The Board shall control the said reserves in accordance with the provisions of the said Act and of the regulations made thereunder.


SCHEDULE.

ALL that area in the Otago Land District, containing by admeasurement 156 acres 3 roods, more or less, being Sections 132 to 152 and 154 to 156 inclusive, together with closed streets, Town of Papatoawai.

Also all that area in the said land district, containing by estimation 786 acres 3 roods, more or less, being Section 1, Block IX, Woodland Survey District.

Also all that area in the said land district, containing by admeasurement 69 acres 2 roods 24 perches, more or less, being Sections 18, 19, and 20, Block XV, Rimu Survey District, and Sections 27 and 28, Block IX, Woodland Survey District.

Also all that area in the said land district, containing by admeasurement 19 acres 3 roods 1 perch, more or less, being Sections 29, 30, and 31, Block IX, Woodland Survey District.

Also all that area in the said land district, containing by admeasurement 208 acres 1 rood 28 perches, more or less, being Section 23, Block IV, Tautuku Survey District.

As the same are more particularly delineated on the plan marked L. and S. 4/422A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Amending the Financial Instructions and Allowance Regulations for the New Zealand Military Forces.


AMENDMENT No. 39.


BLEDISLOE, Governor-General.

IN pursuance and exercise of the powers and authorities conferred on me by the Defence Act, 1909, and its amendments, I, Charles, Baron Bledisloe, Governor-General of the Dominion of New Zealand, do hereby amend in the manner and to the extent set forth in the Schedule hereto the Financial Instructions and Allowance Regulations for the New Zealand Military Forces, published in the New Zealand Gazette dated the sixth day of August, one thousand nine hundred and twenty-five; and I do hereby declare that the amendment hereby made shall take effect as from the first day of April, one thousand nine hundred and thirty-four.


SCHEDULE.

FINANCIAL INSTRUCTIONS AND ALLOWANCE REGULATIONS FOR THE NEW ZEALAND MILITARY FORCES.

PARAGRAPH 47A, as amended by Gazette No. 90 dated the 6th day of December, 1934, is hereby further amended by deleting the rate of pay set opposite the rank of Flight-Lieutenant (after 2 years), and substituting in lieu thereof “£374 5s.”

IN pursuance and exercise of the power and authority conferred upon me by the Mining Act, 1926, and of all other powers and authorities enabling me in this behalf, I, Charles, Baron Bledisloe, Governor-General of the Dominion of New Zealand, do hereby declare the post-office at Waikaia to be a post-office at which Miners’ Rights may be issued by the Postmaster in charge of such post-office.

As witness the hand of His Excellency the Governor-General, this 15th day of January, 1935.
