Revoking Order in Council of 7th August, 1933, licensing A. W. Bryant, Ltd., of Auckland, to occupy a Part of the Foreshore near Waiaro, Coromandel Peninsula, Hauraki Gulf, for the Purpose of taking Shingle.

At the Government Buildings at Wellington, this 7th day of June, 1935.

Present:

THE HON. SIR ALEXANDER YOUNG PRESIDING IN COUNCIL.

WHEREAS by Order in Council dated the seventh day of August, one thousand nine hundred and thirty-three, and published in the Gazette of the tenth day of August, one thousand nine hundred and thirty-three, at page 2010, A. W. Bryant, Ltd., of Auckland, was licensed to occupy a part of the foreshore near Waiaro, Coromandel Peninsula, Hauraki Gulf, for the purpose of taking away the shingle deposited thereon: And whereas it is desirable to revoke the said Order in Council of the seventh day of August, one thousand nine hundred and thirty-three:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the seventh day of August, one thousand nine hundred and thirty-three, as from the thirty-first day of March, one thousand nine hundred and thirty-five.

The Eastern Side of Portion of Perth Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 7th day of June, 1935.

Present:

THE HON. SIR ALEXANDER YOUNG PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the twenty-ninth day of April, one thousand nine hundred and thirty-five, viz.:

“The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, hereby by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portion of the east side of Perth Street adjoining the land comprised in Certificate of Title, Volume 423, folio 185 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Perth Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

The eastern side of all that portion of street, situated in the Canterbury Land District, City of Christchurch, known as Perth Street, fronting Lot 1, D.P. 9512, being part Rural Section 33. As the said portion of street is more particularly delineated on the plan marked P.W.D. 89569, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to those portions of Rutland and Lorne Streets, adjoining part of Allotment 60, Section 32, City of Auckland, comprised in 3 A. 1738 ”;

such portions of streets being described in the Schedule hereto.

SCHEDULE.

The southern side of all that portion of street, situated in the North Auckland Land District, City of Auckland, known as Rutland Street, fronting part Allotment 60, Section 32, City of Auckland.

Also the western side of all that portion of street, situated in the said land district and city, known as Lorne Street, fronting part Allotment 60, Section 32, City of Auckland.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 89339, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Vesting the Control of a Scenic Reserve in the Papatoawai Scenic Board.

GALWAY, Governor-General.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserve described in the Schedule hereto (being land reserved under the said Act), in trust, for the purposes of scenery preservation, as from the date of this notice until the eighteenth day of January, one thousand nine hundred and forty (unless previously altered or revoked under the said Act), in the Papatoawai Scenic Board, as constituted by notification dated the nineteenth day of January, one thousand nine hundred and thirty-five, and published in the Gazette of the twenty-fourth day of that month.

SCHEDULE.

OTAGO LAND DISTRICT.

SECTION 25, Block IV, Tautuku Survey District: Area, 25 acres 2 roods 4 perches, more or less.

As witness the hand of His Excellency the Governor-General, this 10th day of June, 1935.
