Extending the Definition of the Term “Motor-vehicle” in terms of Section 2 of the Motor-vehicles Act, 1924, and making Consequential Alterations to the Taxation on Motor-vehicles in terms of the Motor-vehicles Amendment Act, 1934–35.

ORDER IN COUNCIL.

At the Government House at Wellington, this 13th day of May, 1935.

His Excellency the Governor-General in Council.

I N pursuance and exercise of the powers and authorities conferred on him by the Motor-vehicles Act, 1924, the Motor-vehicles Amendment Act, 1927, the Motor-vehicles Amendment Act, 1934–35, and of every other power and authority in anywise enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS.

  1. These regulations may be cited as the Motor-vehicles (Special Types) Regulations, 1935.

  2. These regulations shall come into force on the 1st day of June, 1935.

  3. In these regulations “the principal Act” means the Motor-vehicles Act, 1924.

  4. (1) It is hereby declared pursuant to the power in that behalf contained in the definition of “motor-vehicle” in section 2 of the principal Act that all locomotives and vehicles propelled by self-contained mechanical power and conforming to any of the descriptions contained in the First Schedule hereto shall be motor-vehicles within the meaning of the principal Act.

(2) The Motor-vehicles (Tractors) Regulations, 1928, published in the Gazette on the 16th day of May, 1929, at page 1404, are hereby consequently revoked.

  1. It is hereby declared pursuant to the power in that behalf contained in the paragraph numbered 2 of the First Schedule to the Motor-vehicles Amendment Act, 1934–35, that the following motor-vehicles shall be exempt from the payment of annual license fees under the principal Act:—

(i) Such motor-vehicles of the Classes numbered 3 and 4 in the First Schedule hereto as are used on public roads only in proceeding from one place to another for the purpose of driving any of the apparatus referred to in the said First Schedule hereto or for the garaging or repair of such motor-vehicles.

(ii) All motor-vehicles of the kinds described in the Second Schedule hereto.

  1. It is hereby declared pursuant to the power in that behalf contained in section 4 of the Motor-vehicles Amendment Act, 1934–35, that the provisions of the said section 4 shall be applied to all motor-vehicles of the following types or classes—namely, such motor-vehicles of the class numbered 4 in the First Schedule hereto as are used on public roads only in proceeding from one place to another for the purpose of driving any of the apparatus enumerated in the said First Schedule hereto or for the garaging or repair of such motor-vehicles.

FIRST SCHEDULE.

Class 1.—The locomotive commonly known as a traction-engine, whether or not used solely for purposes of traction.

Class 2.—The locomotive commonly known as a tractor, whether or not used solely for purposes of traction.

Class 3.—Any motor-vehicle or locomotive designed or adapted solely or principally for driving ploughs, harrows, cultivators, reapers and binders, haysweeps, threshing-combines, chaffcutters, or other similar agricultural apparatus.

Class 4.—Any motor-vehicle or locomotive designed or adapted solely or principally for driving—

(a) Well-boring apparatus;
(b) Saw-bench apparatus;
(c) Cranes; or
(d) Air-compressor plants.

SECOND SCHEDULE.

(1) Any agricultural tractor as defined by section 2 of the Motor-spirits Taxation Amendment Act, 1928, if used for agricultural purposes connected only with a farm or farms occupied by a person who is an owner of the tractor within the meaning of the principal Act.

(2) Any motor-vehicle which is designed and used exclusively or principally in connection with the construction or maintenance of roads or streets and which upon application by or on behalf of the owner is approved by the Minister of Transport for exemption under this Schedule, as from the date fixed in such approval.
