sinking fund; and whereas it is expedient to authorize repayment on the instalment-repayment system over a period of twenty-five (25) years:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid by prescribing that in lieu of making provision for the repayment of the said sum by establishing a sinking fund in respect thereof, the said local authority shall repay the said sum of thirty-five thousand pounds (£35,000) by equal aggregate annual or half-yearly instalments including principal and interest extending over a term of twenty-five (25) years.

Order in Council varying the Determinations in respect of Part (£5,000) of the Hamilton Borough Council’s Loan of £9,000 by prescribing Repayment on the Instalment-repayment System.

At the Government House at Wellington, this 29th day of April, 1935.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

W HEREAS by Order in Council made on the twenty-seventh day of August, one thousand nine hundred and thirty-four, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Hamilton Borough Council (hereinafter called “the said local authority”) of the sum of nine thousand pounds (£9,000) by a loan to be known as “Fairfield Bridge Loan, 1934” (hereinafter called “the said loan”):

And whereas the said loan has not yet been raised, and it is expedient to vary the determinations aforesaid in respect of part thereof—namely, the sum of five thousand pounds (£5,000) (hereinafter called “the said sum”):

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing that the said local authority may, in lieu of making provision for the repayment thereof by the establishment of a sinking fund, raise the said sum or any part thereof upon terms of making the same, together with interest thereon at a rate being such as shall not produce to the lenders a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum, repayable by equal aggregate annual or half-yearly instalments extending over a period of twenty-five (25) years.

Recreation Reserve in Auckland Land District brought under Part II of the Public Reserves, Domains, and National Parks Act, 1928.

ORDER IN COUNCIL.

At the Government House at Wellington, this 29th day of April, 1935.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

B Y virtue of the powers and authorities vested in me by the thirty-fourth section of the Public Reserves, Domains, and National Parks Act, 1928, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the Auckland Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of Part II of the said Act, and such reserve shall hereafter form part of the Turua Domain, and be managed, administered, and dealt with as a public domain by the Turua Domain Board.

SCHEDULE.

AUCKLAND LAND DISTRICT.

ALL that parcel of land, containing by admeasurement 4 acres 0 roods 2:28 perches, being Lots 256, 257, 258, 259, 260, 261, 262, and 263 on a plan deposited in the Land Registry Office at Auckland under No. 16375, being portion of Awakahawai No. 3, Raupoti No. 3A Section I, and Raupoti Blocks, situated in Block III, Waihou Survey District. As the same is more particularly delineated on the plan marked L. and S. 1/726A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged blue.

NORTH AUCKLAND LAND DISTRICT.

ALL that area containing by admeasurement 2 roods 4 perches, more or less, being Allotment No. 46 of Section 2, Takapuna Parish. As the same is more particularly delineated on the plan marked L. and S. 1/453, deposited in the Head Office, Lands and Survey Department, at Wellington, and thereon edged red. (Auckland plan S.O. 4837.)

WESTLAND LAND DISTRICT.

RESERVE 1163, Block IV, Brunner Survey District: Area, 1 acre 2 roods 17-1 perches, more or less.
