A PROCLAMATION.

IN pursuance and exercise of the powers and authorities vested in me by the Public Works Act, 1928, and of every other power and authority in anywise enabling me in this behalf, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the land which is described in the Schedule hereto (and which was acquired for the Waitaki-Bluff Railway (Waihola-Clutha Section) and is not now required for such purpose) shall, upon the publication hereof in the New Zealand Gazette, become a road, and that such road shall be maintained by the Bruce County Council in like manner as other public highways are controlled and maintained by the said Council.

Additional Regulations under the British Nationality and Status of Aliens (in New Zealand) Act, 1928.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred on him by section fourteen of the British Nationality and Status of Aliens (in New Zealand) Act, 1928, and of all other powers enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following additional regulations for the purposes of the said Act and of Part II of the Imperial Act in its application to New Zealand, and doth hereby declare that the regulations hereby made shall come into force on the date of their publication in the Gazette.

REGULATIONS.

1. (1) These regulations may be cited as the Naturalization Amendment Regulations, 1935.
   (2) In these regulations—
   “ The said Act ” means the British Nationality and Status of Aliens (in New Zealand) Act, 1928 :
   “ The principal regulations ” means the Naturalization Regulations, 1929 (being regulations made under the said Act by Order in Council dated the 2nd day of September, 1929, and published in the Gazette of the 5th day of the same month).

2. (1) A declaration by the wife of a naturalized British subject that she desires to acquire British nationality under section 10 of the Imperial Act (as set out in the Schedule to the British Nationality and Status of Aliens (in New Zealand) Amendment Act, 1934–35) in the application of the said section to New Zealand, shall be in the Form No. 1 in the First Schedule hereto.

(2) Clause 9 of the principal regulations is hereby amended by inserting the words “ or acquisition ” after the word “ resumption ” wherever that word occurs in the said clause.

3. (1) A declaration by a British woman who has been married to an alien that she desires to retain while in New Zealand the rights of a British subject in accordance with the provisions of section 3 of the British Nationality and Status of Aliens (in New Zealand) Amendment Act, 1934–35, shall be in the Form No. 2 in the First Schedule hereto.

(2) A declaration made for the purposes of this clause may be made before a Stipendiary Magistrate but not otherwise. Every such declaration shall be registered in the Department of Internal Affairs at Wellington.

(3) With respect to declarations made for the purposes of this clause, the following provisions shall apply :—
(a) Every such declaration shall be subscribed in duplicate ;
(b) The Stipendiary Magistrate taking any such declaration shall transmit to the Department of Internal Affairs at Wellington the two copies thereof ; and
(c) On payment by the declarant of the prescribed fee for registration, one copy shall be officially noted as having been registered and shall be returned to the declarant, and one copy shall be filed in the Department.

4. Clause 7 of the principal regulations is hereby revoked, and the following clause substituted therefor :—
   “ 7. (1) Except in the case of persons resident in the Cook Islands or in Western Samoa, the oath of allegiance shall be taken within one calendar month after the date of the certificate of naturalization to which it relates ; in the case of persons resident in the Cook Islands or in Western Samoa, the oath of allegiance shall be taken within three months after the date of the certificate of naturalization.
   “ (2) Notwithstanding anything in the last preceding subclause, the Minister of Internal Affairs may, if he thinks fit, extend the time within which the oath of allegiance may be taken.
   “ (3) If the oath of allegiance is not duly taken the certificate of naturalization shall not take effect.”

5. The Form No. 5 in the First Schedule to the principal regulations is hereby amended by omitting from the list of “ Particulars relating to Applicant ” the word “ Nationality ” after the words “ Place and Date of Birth.”

6. (1) Fees in accordance with the Second Schedule hereto shall be payable into the Consolidated Fund in respect of the several matters therein mentioned.
   (2) Subclause (1) of clause 11 of the principal regulations and the Second Schedule to those regulations are hereby revoked.
