Order in Council prescribing the Conditions in respect of Part, viz., £2,500, of the Waitomo Electric-power Board's Loan of £20,000.

ORDER IN COUNCIL.
At the Government House at Wellington, this 6th day of August, 1934.

His Excellency the Governor-General in Council.
WHEREAS by Order in Council made on the eighteenth day of October, one thousand nine hundred and twenty-six, and published in the Gazette of the twenty-eighth idem, at page 3014, consent was given to the raising by the Waitomo Electric-power Board (hereinafter called “the said local authority”) of a loan of twenty thousand pounds (£20,000), to be known as “House-wiring and Trading Loan, 1926” (hereinafter called “the said loan”):
And whereas the sum of two thousand five hundred pounds (£2,500) (hereinafter called “the said sum”), being part of the said loan, has not yet been raised, and it is expedient to determine the conditions upon which the said sum may be raised:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby determine that the said sum of two thousand five hundred pounds (£2,500) or any part thereof may be raised by the said local authority subject to the following conditions:—

The term for which the said sum or any part thereof may be raised shall be twenty (20) years.

The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds fifteen shillings (£3 15s.) per centum per annum.

The said local authority shall, before raising the said sum or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies’ Loans Act, 1926, or under such other statutory enactment as may be applicable, and shall thereafter make payments to such sinking fund at intervals of not more than one year, at a rate or rates per centum which shall be not less than three pounds seven shillings and sixpence (£3 7s. 6d.), such payments to be made in respect of every part of the said sum for the time being so raised and not repaid, the first such payment to be made not later than one year after the first day from which interest to the lender or lenders is computed on any amount so raised.

No amount payable as either interest or sinking fund in respect of the said sum shall be paid out of loan-money.

The rate payable for brokerage, underwriting, and pro-curation fees in respect of the raising of the said sum or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.

The payment of interest and repayment of principal shall be made in New Zealand.

No moneys shall be borrowed under this authority after the expiration of two years from the date hereof.

The South-eastern Side generally of Portion of Brook Street, in the City of Nelson, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 6th day of August, 1934.

His Excellency the Governor-General in Council.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the twenty-fifth day of June, one thousand nine hundred and thirty-four, viz.:—
“That the Nelson City Council, being the local authority having control of the streets in the City of Nelson, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Brook Street adjoining part sections 1 of 8, 1 Rural, 4, and 35, Brook Street and Maitai, City of Nelson, as shown on the plan annexed hereto and thereon coloured pink and marked ‘A–B’”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side generally of the portion of Brook Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE south-eastern side generally of all that portion of street, situated in the Nelson Land District, City of Nelson, known as Brook Street, fronting parts Sections 35, 1 Rural, 1 of 8, and 4, District of Brook Street and Maitai, Block I, Maungatapu Survey District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 87648, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured pink.

Notifying the Proposed Exchange of Crown Land in the Wellington Land District for other Land.
BLEDISLOE, Governor-General.
WHEREAS by section one hundred and sixty of the Land Act, 1924, it is enacted that it shall be lawful for the Governor-General, whenever he deems it expedient in the public interest, to grant in fee-simple any area of Crown land which is subject to the provisions of the Land Act, 1924, in exchange for the fee-simple of any other land, and on any such exchange to pay or receive any sum by way of equality of exchange:
And whereas in the opinion of the Governor-General it is expedient to exchange the Crown land described in the First Schedule hereto for the land described in the Second Schedule hereto, and the owner of the land described in the Second Schedule has agreed to such exchange:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the land described in the Second Schedule.
FIRST SCHEDULE.
DESCRIPTION OF LAND AUTHORIZED TO BE EXCHANGED.
(Wellington Land District.)
SECTION 100, Block IV, Pencarrow Survey District; Area, 94 acres, more or less.
SECOND SCHEDULE.
DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR.
ALL that area in the Wellington Land District, containing by admeasurement 29 acres 0 roods 27 perches, more or less, being part of Section 47, Harbour Registration District, situated in Block I, Pencarrow Survey District, and bounded as follows: Towards the north-east by Section 46 for a distance of 863 links; towards the east by other part of Section 47 for distances of 545·7 links and 1180·5 links; towards the south-east by other part of Section 47 for a distance of 2274·5 links; and towards the north-west by Sections 48
