Amending Regulations under the Sale of Food and Drugs Act, 1908.—(H.F. & D. 97.)

At the Government House at Wellington, this 6th day of August, 1934.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred on him by the Sale of Food and Drugs Act, 1908, and of all other powers enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the regulations made under the said Act on the twenty-third day of June, one thousand nine hundred and twenty-four, and gazetted on the twenty-sixth day of the same month (hereinafter referred to as the “principal regulations”) as follows:—

Regulation 84 of the principal regulations relating to drugs is hereby revoked and the following substituted therefor:—

“84. (1) Drugs which are included in the 1932 edition of the “British Pharmacopoeia” shall conform to the descriptions and tests respectively prescribed therein, unless otherwise standardized in these regulations, or in any Act in force in New Zealand, or in regulations made thereunder.”

(2) Drugs which are not included in the 1932 edition of the “British Pharmacopoeia,” but which are included in the 1923 edition of the “British Pharmaceutical Codex,” shall conform to the descriptions and tests respectively prescribed for them in the said Codex, unless otherwise standardized in these regulations, or in any Act in force in New Zealand, or in regulations made thereunder.”

Changing the Purpose of Part of a Reserve in Block XV, Makuri Survey District, Wellington Land District.

ORDER IN COUNCIL.

At the Government House at Wellington, this 6th day of August, 1934.

His Excellency the Governor-General in Council.

WHEREAS the land described in the Schedule hereto forms part of a reserve duly set apart for water-conservation and climatic purposes: And whereas it is expedient that the purpose of the reservation over such land shall be changed to a site for a roadman’s cottage:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by subsection one (a) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that the purpose of the reservation over the land described in the Schedule hereto is hereby changed from a reserve for water-conservation and climatic purposes to a site for a roadman’s cottage.

License authorizing Francis Joseph Delaney, of Inangahua Junction, to use Water from a Tributary of Dee Creek for the purpose of generating Electricity, and to erect Electric Lines.

ORDER IN COUNCIL.

At the Government House at Wellington, this 6th day of August, 1934.

Present:

His Excellency the Governor-General in Council.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby grant to Francis Joseph Delaney, of Inangahua Junction, a license subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of the tributary of Dee Creek hereinafter described, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding half a cubic foot per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described.

CONDITIONS.

  1. IMPLIED CONDITIONS.

The conditions directed to be implied in all licenses by the Water-power Regulations, 1934, shall be incorporated in and shall form part of this license, except in so far as the same may be inconsistent with the provisions hereof.

  1. UTILIZATION OF WATER AND LOCATION OF HEADWORKS.

Water shall be used under this license solely for the purpose of generating electricity, and shall be taken from the stream at a point approximately 2¼ chains from its confluence with Dee Creek, as indicated on the plan marked P.W.D. 86876, deposited in the office of the Minister of Public Works.

  1. GENERAL DESCRIPTION OF WORKS.

The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the positions of the said works being indicated on the said plan P.W.D. 86876:—

(a) Headworks consisting of dam and necessary intake:

(b) Pipe-line from the stream to the generating station and tail-race from the generating station to the stream:

(c) Power-house with all necessary equipment, including water turbines, generators, transformers, lightning-arresters, switchboards, switches, exciters, and other appliances for generating electricity:

(d) Electric lines from the power-house across provisional State forest, across the Westport–Nelson Main Highway, and across Section 33, Block V, Inangahua Survey District, to the licensee’s residence and out-buildings on the said Section 33.

  1. DURATION OF LICENSE.

This license shall, unless sooner determined, continue in force until the 31st day of March, 1955.

  1. SYSTEM OF SUPPLY.

The system of supply shall be as described in paragraph (c) of clause (5) of the Electrical Supply Regulations, 1927. The generating voltage and the transmission voltage shall be approximately 110 volts.

  1. RENTAL.

For the purpose of assessing the rental or annual sum payable in respect of the license the licensee shall install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and, failing such installation, the rental shall be determined on the maximum capacity of the generating plant installed. The present plant is rated at ¾ kilowatt, and falls within paragraph (b) of clause (2) of Regulation 6 of the Water-power Regulations, 1934.

  1. CONDITIONS OF USE OF PROVISIONAL STATE FOREST.

In respect of the provisional State forest upon which the generating station will be erected, and which will be traversed by the licensee’s electric lines, the following special conditions shall apply:—

(a) The licensee will take all reasonable precautions to protect the forest from fire:

(b) The licensee will be responsible for and will pay full compensation for any damage to the forest by fire or otherwise caused by him or his contractors or employees or his or their assistants:

(c) The area shall at all times be open for inspection by a Forest Officer:

(d) The licensee and his contractors and servants will comply with any request or instruction by a Forest Officer for the protection of the forest from fire:

(e) No timber shall be cleared beyond what is absolutely essential for the purpose of erecting the electric line, and in this matter the decision of an officer deputed by the Director of Forestry shall be final:

(f) This license shall not be deemed to confer upon the licensee any rights in, over, or upon the said provisional State forest except such as are hereby expressly conferred:

(g) If the Director of Forestry at any time certifies that in his opinion it is necessary in the interests of the forest that the licensee’s power-house and lines be removed from the provisional State forest, the Governor-General in Council may forthwith revoke this license.
