Warrant apportioning the Cost of certain Works executed and to be executed for the Control of Flood-waters of the Tutaekuri River, and apportioning the Cost of a Commission of Inquiry.
BLEDISLOE, Governor-General.
WHEREAS the Hawke’s Bay Rivers Board (hereinafter referred to as “the Board”) has from time to time executed works for the control of flood-waters of the Tutaekuri River and now proposes to execute the Tutaekuri flood-control works described in the Hawke’s Bay Rivers Amendment Act, 1930, as amended by the Hawke’s Bay Rivers Amendment Act, 1932–33 (which works already executed and to be executed are hereinafter referred to as “the works”):
And whereas the cost to the Board of the portions of the works already executed amounts to the sum of £33,000:
And whereas the cost of the portions of the works to be executed has been estimated at the sum of £112,000, comprised of the sum of £16,000 for the Washout Traffic Bridge and £96,000 for the remainder of the works to be executed: And whereas arrangements have been made for the Unemployment Board to contribute a sum estimated at £24,000 towards the cost of labour, the Minister of Public Works to contribute approximately £36,000, and the Main Highways Board to contribute one-half of the cost of the Washout Traffic Bridge: And whereas the balance of the cost to be provided in accordance with the provisions of the Hawke’s Bay Rivers Act, 1919, and amendments, is estimated to be £8,000 for the Washout Traffic Bridge and £36,000 for the remainder of the works to be executed: And whereas it appears that the works are safeguarding or will safeguard from damage public highways and other public works under the control and management of the Hawke’s Bay County Council (hereinafter called “the County Council”) and property of the County Council: And whereas it appears that the works are safeguarding or will safeguard from damage harbour works and other works made or maintained or proposed to be made or maintained by the Napier Harbour Board (hereinafter called “the Harbour Board”) and property of the Harbour Board, and are reclaiming or otherwise improving or will reclaim or otherwise improve lands belonging to the Harbour Board: And whereas it appears that certain areas within the Borough of Napier but outside the Hawke’s Bay Rivers District are deriving or will certainly derive benefit from the works: And whereas no preliminary agreement for apportioning the cost of the works has been made between the Board and the County Council, or between the Board and the Harbour Board, or between the Board and the Napier Borough Council: And whereas the Board could not agree with the said County Council, Harbour Board, and Napier Borough Council, respectively, as to what proportion of the said cost was fairly chargeable to each of them or upon the said areas: And whereas the Board applied under sections 16 and 17 of the Hawke’s Bay Rivers Act, 1919, for the cost of the works to be apportioned between the Board and the said County Council, Harbour Board, and Napier Borough Council: And whereas by Warrant dated the 29th day of November, 1933, John Saxon Barton, Esquire, Stipendiary Magistrate, of Wellington, was appointed a Commissioner to hold an inquiry into the matters in dispute between the Board and the County Council, the Harbour Board, and the Napier Borough Council, respectively, and to report to me concerning the said matters on the 7th day of December, 1933:
Now, therefore, I, Charles, Baron Bledisloe, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the Hawke’s Bay Rivers Act, 1919, and of every other power in anywise enabling me in this behalf, do hereby determine the said matters as follows:—

The sum of £33,000, being the cost of works already executed, shall be borne wholly by the Board.

The cost of the Washout Traffic Bridge, after deducting the contributions from the Main Highways Board, shall be apportioned equally between the Board and the County Council.

The cost of the works to be executed, excluding the Washout Traffic Bridge, shall, after deducting all contributions, grants-in-aid, and subsidies from other sources, be paid by the bodies listed hereunder in the same proportions as the sums respectively set opposite their names bear to the sum of £36,000.

The cost of the Commission of Inquiry hereinbefore referred to shall be paid by the bodies listed hereunder in the same proportions as the sums respectively set opposite their names bear to the sum of £44,000.
