Authorizing the Laying-off of a Street in the Town District of
Johnsonville of a Width of less than 66 ft. but not less than
40 ft., subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 15th day of
December, 1933.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers vested in him by
the Municipal Corporations Act, 1920, and the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby authorize the Johnsonville Town Board to permit
the laying-off of the proposed street, described in the Schedule
hereto, of a width of less than sixty-six feet, but not less than
forty feet, subject to the condition that no building or part of
a building shall at any time be erected on the land fronting the
said street within a distance of thirty-five feet from the
centre-line of the said street.
SCHEDULE.
THAT proposed street in the Wellington Land District, Town
District of Johnsonville, known as Gladstone Avenue, con-
taining by admeasurement 1 rood 16·45 perches, more or less,
being portion of parts Section 10, Porirua R.D., Block XII,
Belmont Survey District. As the same is more particularly
delineated on the plan marked P.W.D. 86491, deposited in
the office of the Minister of Public Works at Wellington, and
thereon coloured red.

Amending Order in Council of the 11th April, 1924, making
Regulations and fixing Dues and otherwise with respect to
the Great Barrier Island County Council Wharves.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the eleventh
day of April, one thousand nine hundred and twenty-
four, and published in the Gazette of the seventeenth day
of the same month, at page 917, regulations were made and
dues fixed with respect to the Great Barrier Island County
Council wharves :
And whereas it is desirable to amend the said Order in
Council in the manner hereinafter appearing :
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, in pursuance and exercise of the
power and authority conferred upon him by the Harbours
Act, 1923, and of all other powers and authorities enabling
him in that behalf, and acting by and with the advice and
consent of the Executive Council of the said Dominion, doth
hereby amend the hereinbefore-recited Order in Council
of the eleventh day of April, one thousand nine hundred and
twenty-four, by revoking clause 17 thereof, and substituting
the following clause in lieu thereof :—
“ 17. Every person, firm, or company who uses any wharf,
jetty, or landing reserve under the control of the Council, and
any other wharf that may hereafter come under the control
of the Council, for landing or shipping any goods, shall pay to

or measurement, whichever is the greater, per weight or per
ton measurement. Per ton means 20 cwt. per ton, measure-
ment means 40 cubic feet.
