Additional By-laws relating to Westport Harbour.

ORDER IN COUNCIL.

At the Government House at Wellington, this 13th day of December, 1933.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council dated the thirteenth day of April, one thousand nine hundred and twenty-seven, and published in the Gazette of the following day, at page 961, by-laws relating to Westport Harbour were made:

And whereas it is expedient to make the following additional by-laws:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by sections nine and two hundred and twenty-six of the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following by-laws relating to the Harbour of Westport, and doth hereby order that they shall come into force on the fifteenth day of September, one thousand nine hundred and thirty-three.

BY-LAWS.

  1. THE master of any vessel which touches on the bar when outward bound from the harbour shall immediately advise the signal station by sounding a clear blast of about three seconds’ duration on the ship’s whistle. If the vessel touches more than once an additional short blast shall be sounded on each occasion on which the bar is touched.

  2. The officer in charge of the signal station at the time when any such signal is given shall forthwith acknowledge it by exhibiting from the northern yardarm a black ball by day, and a red light, which shall be visible all round, by night, and shall keep such signal exhibited until the vessel is well clear of the bar.

  3. If the master of the vessel does not receive such acknowledgment he shall, when clear of the bar, advise the signal station by means of the International or the Morse Code of Signals.

  4. Every person who fails or neglects to comply with any of the above by-laws shall be liable to a fine of twenty pounds (£20).

Cancelling the Reservation over a Reserve in the Town of Mackenzie, Canterbury Land District.

ORDER IN COUNCIL.

At the Government House at Wellington, this 12th day of December, 1933.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby cancel the reservation as a reserve for the use of the Department of Agriculture over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.

SCHEDULE.

ALL that area in the Canterbury Land District, containing by admeasurement 2 acres 1 rood 25 perches, more or less, and being Reserve 3243, situated in the Town of Mackenzie, in Block VII, Cheviot Survey District, and bounded as follows: Towards the north-west by Saunders Street, 310·0 links; towards the north by Ward Street, 560·8 links; towards the east by Crown land, 356·0 links; and again towards the south by the Woolshed Stream and by Crown land, 45·0 links. As the same is more particularly delineated on the plan marked L. and S. 38008, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

License authorizing H. J. Wardell, of Bog Roy, to use Water for the Purpose of generating Electricity.

ORDER IN COUNCIL.

At the Government House at Wellington, this 12th day of December, 1933.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to H. J. Wardell, of Bog Roy (hereinafter with his successors and assigns referred to as “the licensee”), a license subject to the conditions hereinafter set forth to take and use from a stream situated on Run 322d, Gala Survey District, Waitaki County, in the Otago Land District (hereinafter referred to as “the said stream”) for the purposes hereinafter set forth a stream of water (hereinafter referred to as “the said water”) not exceeding nine cubic feet per second at any one time: Provided that nothing herein shall be held to guarantee that the said stream contains sufficient water to supply the volume of water hereinbefore referred to; and all rights hereby granted shall be subject to all existing rights heretofore granted under the Mining Acts or otherwise.

CONDITIONS.

  1. REGULATIONS.

THIS license is subject to the Electrical Supply Regulations, 1927, the Electrical Wiring Regulations, 1927, and any regulations made or to be made in amplification or amendment thereof or in substitution therefor.

  1. PLANS.

The licensee shall forward for the approval of the Minister of Public Works (hereinafter referred to as “the Minister”)—

(a) Full detailed drawings and specifications of the diverting weirs.

(b) Drawings showing how and in what manner the water is diverted.

(c) Contour-plans showing difference in level of water due to the construction of the headworks.

(d) Drawings giving full particulars of any tunnels, aqueducts, and pipe-lines used in conveying the water from the headworks to the power-station.

(e) Drawings showing the arrangement of the generating, switching, and transforming plant in the power station.

  1. UTILIZATION OF THE WATER AND LOCATION OF HEADWORKS.

The said water shall be used under this license solely for the purpose of generating electricity up to a maximum capacity of 10 kw. for lighting or heating or power purposes. The said water shall be taken from the said stream situated in Run 322d, Gala Survey District, Waitaki County, as indicated on the plan marked P.W.D. 85802 (hereinafter referred to as “the said plan”), deposited in the office of the Minister of Public Works at Wellington.

  1. GENERAL DESCRIPTION OF WORKS.

The licensee is hereby authorized, subject to the conditions herein contained, to construct, maintain, and use the following works for the purposes of this license, the position of the said works being indicated on the said plan:—

(a) Headworks consisting of dam and necessary intakes.

(b) Pipe-lines leading from headrace to the power-house hereinafter referred to; also tailrace from the power-house to the said stream.

(c) Powerhouse with all necessary equipment, including water-turbines, generators, transformers, lightning arresters, switchboards, switches, exciters, and other appliances for generating electricity.

  1. MAINTENANCE OF WORKS.

The licensee shall maintain the said works used under the license in proper working order during the continuance of this license.

  1. DURATION OF LICENSE.

This license shall, unless sooner determined in accordance with the provisions hereinafter expressed, continue in force for a period of twenty-one years from the date hereof. Upon the expiry of the said term, or upon the sooner determination
