Domain Board appointed to have Control of the Denniston Domain.

ORDER IN COUNCIL.
At the Government House at Wellington, this 30th day of January, 1933.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Michael Clark, O.B.E.,
Andrew Ramsay Burt,
George Jack,
James Patrick Doyle,
William Berryman,
George Payne,
Richard Henry Hawes,
John Warren, and
Charles Victor Smith

to be the Denniston Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Monday, the sixth day of February, one thousand nine hundred and thirty-three, at half past six o’clock p.m., as the time when, and the office of the Denniston Domain Board, Denniston, as the place where, the first meeting of the Board shall be held.

Granting Temporary Exemption from Section 50 (4) of the Friendly Societies Act, 1909.

ORDER IN COUNCIL.
At the Government House at Wellington, this 30th day of January, 1933.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to section fifty-five of the Finance Act, 1931 (No. 4), as amended by section thirty of the Finance Act, 1932 (No. 2), His Excellency the Governor-General, being of opinion that compliance with the provisions of subsection four of section fifty of the Friendly Societies Act, 1909, by the Auckland District Branch of the Ancient Order of Foresters of New Zealand Friendly Society, No. 356, being a registered branch within the meaning of the last-named Act (hereinafter called “the said Branch”), in respect of the period of three years ending on the thirty-first day of December, one thousand nine hundred and thirty-four, would impose undue hardship on the said Branch, and acting by and with the advice and consent of the Executive Council, doth hereby grant to the said Branch exemption to the extent hereinafter set out from the obligations of the said subsection four in respect of the period aforesaid—that is to say, that in lieu of the interest at the rate of not less than four per centum per annum payable by the said Branch into any benefit fund of the said Branch in terms of the said subsection four it shall be sufficient compliance with the obligations of the said subsection four relating to moneys forming part of any benefit fund of the said Branch invested in the purchase of the land referred to in the Schedule hereto, and/or the erection of offices or buildings on the said land, if there be paid by the said Branch into any such benefit fund as aforesaid by way of interest for the period of three years aforesaid a sum equal to the net amount received by the said Branch by way of rents and premiums paid (whether before, during, or after the period of three years aforesaid), for any lease, letting, or other tenancy or license of or relating to any part of the said premises during the period of three years aforesaid, and by way of any other revenue obtained from the said premises during the period of three years aforesaid.

ALL that piece of land situated at the corner of Albert Street and Wellesley Street in the City of Auckland, together with the building erected thereon known as the Foresters’ Buildings.

Licensing the Opotiki County Council to use and occupy a Part of the Foreshore and Land below Low-water Mark at Kutarere, Bay of Plenty, as a Site for a Wharf.

ORDER IN COUNCIL.
At the Government House at Wellington, this 30th day of January, 1933.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council dated the twenty-first day of January, one thousand nine hundred and nineteen, and published in the Gazette of the thirtieth day of the same month, at page 217, the Opotiki County Council (hereinafter called “the Council,” in which term is to be construed, unless the context requires a different construction, its successors or assigns), was licensed to use and occupy part of the foreshore and land below low-water mark at Kutarere, Bay of Plenty, in order to erect and maintain a wharf thereon in accordance with the plans marked M.D. 5007, and deposited in the office of the Marine Department at Wellington, for the term of fourteen years computed from the twenty-first day of January, one thousand nine hundred and nineteen:

And whereas the Council has applied for a license under the Harbours Act, 1923 (hereinafter called “the said Act”), for a further term of fourteen years, and it is advisable to grant the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the purpose or object for which the said license is required by the Council as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the Council
