Order in Council varying the Determinations as to the Borrowing and Repayment of the Mangonui Hospital Board's Loan of £3,000.

ORDER IN COUNCIL.
At the Government House at Wellington, this 17th day of October, 1933.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council made on the seventh day of October, one thousand nine hundred and thirty-three, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Mangonui Hospital Board (hereinafter called “the said local authority”) of the sum of three thousand pounds (£3,000) by a loan to be known as “Kaitaia Hospital Loan, 1933” (hereinafter called “the said loan”):
And whereas the said loan has not yet been raised, and it is expedient to vary certain of the determinations aforesaid relating to the borrowing and repayment thereof:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and by section thirty-two of the Local Bodies' Loans Act, 1926, and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid by consenting to the raising of the said loan by the said local authority upon terms of making the same, together with interest thereon at a rate not exceeding £4 5s. per centum as prescribed by the said Order in Council of the seventh day of October, one thousand nine hundred and thirty-three, repayable by equal aggregate annual or half-yearly instalments extending over a period not exceeding five (5) years.

Amending Regulations dated 26th September, 1932, for Whitebait-fishing.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the twenty-sixth day of September, one thousand nine hundred and thirty-two, and published in the Gazette of the sixth day of the following month, at page 2086, amending regulations for whitebait-fishing were made under the Fisheries Act, 1908 (hereinafter referred to as “the said Act”):
And whereas it is desirable to amend the said regulations in the manner hereinafter described:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the said regulations of the twenty-sixth day of September, one thousand nine hundred and thirty-two, by making the regulations set out in the Schedule hereto; and doth hereby order and declare that these regulations shall come into force on the date of publication thereof in the Gazette.
SCHEDULE.
REGULATION 5 of the hereinbefore-recited regulations is hereby amended by deleting the words “No hand-net shall be used for taking whitebait the mouth of which has a diameter or greatest width exceeding 4 ft.” and substituting the following words in lieu thereof:—
- “No person shall use for taking whitebait any hand-net the mouth of which has an area exceeding 9 sq. ft., except in the case of a net with a circular mouth, in which case the diameter of the mouth shall not exceed 4 ft.”

Regulations under the Fisheries Act, 1908.

ORDER IN COUNCIL.
At the Government House at Wellington, this 17th day of October, 1933.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance of the powers and authorities conferred by the fifth, eighty-third, and ninety-fourth sections of the Fisheries Act, 1908, and of all other powers and authorities in that behalf enabling, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations, and doth hereby order and declare that they shall come into force on the date of publication thereof in the Gazette.
REGULATIONS.
- No person shall put, stake, drag, draw, or place, or allow to be put, dragged, drawn, or placed, for the purpose of taking indigenous fish, any net of any description except a landing-net or whitebait-net in the Waimakariri River or the Ashley River: Provided that nothing herein contained shall prevent the placing or using of any net other than a stake-net in the mouths of the said rivers, or within the hereinafter-mentioned tidal waters thereof :—
The Waimakariri River: The tidal waters east of a straight line drawn at right angles to and across the said river from the eastern corner of Rural Section 1393 in the Mandeville Survey District, the said corner of Rural Section 1393 being approximately two miles in an easterly direction from the main bridge over the said river to the town of Kaiapoi.
The Ashley River: The tidal waters east of a straight line drawn from the north-eastern corner of Rural Section 2931 to the jetty situated approximately four hundred yards below the bridge over Salt Water Creek.
- Any person committing a breach of this regulation shall be liable to a penalty of £50.

Revoking certain Regulations deemed to be Board of Trade Regulations.

ORDER IN COUNCIL.
At the Government House at Wellington, this 17th day of October, 1933.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS section five of the War Regulations Continuance Act, 1920, provides that the regulations mentioned in the Schedule hereto shall be deemed to be Board of Trade Regulations under the Board of Trade Act, 1919 :
And whereas it is now desirable that the said regulations be revoked:
Now, therefore, in pursuance and exercise of the power and authority conferred upon him by section twenty-six of the Board of Trade Act, 1919, as amended by the Board of Trade Amendment Act, 1923, and of every other power and authority enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby, on the recommendation of the Minister of Industries and Commerce, revoke the said regulations as on and from the date of publication of this Order in Council in the Gazette.
