Notice under the Regulations for the Eradication and Prevention of the Spread of Disease among Swine.—(Notice No. Ag. 3114.)

IN pursuance and exercise of the power and authority conferred on me by the regulations for the eradication and prevention of spread of disease among swine, dated the 21st day of May, 1895, and published in the Gazette on the 23rd day of the same month, at page 842, made under the provisions of the Stock Act, 1893, and enuring under the Stock Act, 1908 (hereinafter referred to as “the said Act”), and being satisfied of the matters as to which by the said regulations I am required to be satisfied, I, John George Cobbe, acting for the Minister of Agriculture, do hereby declare the lands described in the First Schedule hereto (hereinafter referred to as “the said infected area”) to be an infected area within the meaning of the said regulations from which no swine, nor any fodder or fittings pertaining to swine, may be removed without the written permission of an Inspector; and I hereby direct that the measures set out in the Second Schedule hereto shall be taken by owners of stock and occupiers of land within the said infected area, and do hereby regulate, as appears in the said Second Schedule, the movements of persons and stock into and out of the said infected area.

FIRST SCHEDULE.

DESCRIPTION OF INFECTED AREA.

ALL that area within the Wellington Land District comprising the counties of Hutt and Makara as at present constituted, and including the City of Wellington, the boroughs of Petone, Lower Hutt, Upper Hutt, and Eastbourne, and the Town District of Johnsonville.

SECOND SCHEDULE.

ACTION IN RESPECT OF INFECTED PLACES.

  1. THE provisions of this Schedule relating to infected places shall apply to every piece of land within the said infected area which has been declared by an Inspector under section 12 of the said Act to be an infected place.

  2. The owner of any swine which are at any time found upon an infected place, or which have since the time of such declaration been upon an infected place, and which are in the opinion of an Inspector diseased or infected, shall, under the supervision of an Inspector, forthwith destroy such swine, and also all fodder or fittings pertaining to such swine, in such manner as the Inspector so supervising may require.

  3. The occupier of any infected place shall take such steps, whether remedial or precautionary, as may be required of him by an Inspector to render or preserve the said land thoroughly free from disease and infection.

  4. On default by the owner of any swine, or by the occupier of any land, in compliance with the foregoing provisions, or with any requirement of an Inspector made as aforesaid, it shall be lawful for an Inspector forthwith to destroy or procure to be destroyed such swine as aforesaid, or any fodder or fittings pertaining to such swine, or to take such steps, whether remedial or precautionary, to render or preserve the said land thoroughly free from disease and infection, as the case may be.

  5. All costs and expenses incurred by an Inspector in exercising the powers conferred by the last preceding clause hereof may be recovered from the person in default as aforesaid in any Court of competent jurisdiction as a debt due to the Crown.

  6. No person, being in an infected place, shall leave such place until, if so required by an Inspector, he has disinfected his boots and clothing to the satisfaction of the Inspector.

MOVEMENTS OF SWINE IN INFECTED AREA.

  1. No person shall without the written consent of an Inspector bring, move, or remove any swine, or any fodder or fittings pertaining to swine, or cause or permit any swine
