Education Act, 1914: Regulations for Intermediate Schools and Departments.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 15th day of December, 1932.

IN pursuance and exercise of the powers conferred on him by the Education Act, 1914, and of all other powers enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the regulations at present in force relating to junior high schools made by Orders in Council as shown in the Schedule hereto, and further doth hereby make the following regulations in substitution therefor, and with the like advice and consent doth prescribe that this order shall come into force on the date of publication thereof in the New Zealand Gazette.

REGULATIONS.

INTERMEDIATE SCHOOLS, INTERMEDIATE DEPARTMENTS, AND CONTRIBUTING SCHOOLS.

  1. For the purpose of these regulations—

“Intermediate school” means a public school to which are admitted from one or more public or Native schools, hereinafter called “contributing schools,” pupils who belong to the senior division as defined in the regulations for the organization and management of public schools.

“Intermediate department” is a department or division attached to a secondary school, a technical school, a combined school, or a district high school to which are admitted from one or more public or Native schools, hereinafter called “contributing schools,” the pupils who belong to the senior division as defined in the regulations for the organization and management of public schools.

“Contributing school” means a public school or a Native school from which pupils of the senior division have been removed to an intermediate school or to the intermediate department of a school.

“Board” means an Education Board or the governing body of any secondary school, technical school, or combined school.

  1. When an intermediate school or intermediate department has been established the Minister may direct the Education Board to limit the instruction given in any public school he may select to the work prescribed for classes not higher than Standard IV, or not higher than Form I, as he may decide, and may require the pupils of the higher class or classes in such schools to attend the intermediate school or department.

  2. (1) In order to qualify for admission to an intermediate school or department a pupil must fulfil the requirements for a certificate of school attainment of Standard IV or some higher standard as prescribed in the Syllabus of Instruction for public schools:

Provided that the Director may in special cases authorize the admission of pupils over a stated age who do not possess the aforesaid qualification, and provided further that the Minister may in his discretion limit admission to pupils residing in an area which he shall define, or limit admission in any other manner.

(2) The head teacher of each contributing school shall on a form provided for the purpose supply to the principal or head teacher of the intermediate school or department a report on each pupil who is about to transfer from the contributing school to the intermediate school or department.

  1. If the accommodation in an intermediate school or department permits, pupils qualified in accordance with the provisions of clause 3 (1) hereof, may, with the approval of the Director, be admitted to such school or department from any school other than those in which the instruction has been limited in accordance with clause 2 hereof.

  2. The period during which a pupil may receive instruction in an intermediate school or department shall, in general, be two years, except that in special cases the Director may approve an extension of the period.

  3. For the purposes of these regulations the roll number for each intermediate school or intermediate department for each year shall be taken to be the total roll of bona fide pupils as on the 1st March :
