MEMBERS.

  1. The Board shall consist of eleven members, to be appointed by the Governor-General in Council as provided in paragraph (a) of the said section.

  2. Subject to the provisions of these regulations as to resignation or forfeiture of office, a member shall hold office for two years, and thereafter until his successor has been appointed. A retiring member may be reappointed.

  3. A member may at any time be removed from office by the Governor-General if the Governor-General is of opinion that that member is, from any cause, incapable of efficiently performing the duties of his office, or has been guilty of any misconduct which renders him unfit for office.

  4. A member may at any time resign his office by notice in writing under his hand sent or delivered to the Under-Secretary.

  5. The office of any member of the Board shall be vacated if he becomes bankrupt or is convicted of an offence punishable by imprisonment.

  6. When a member of the Board dies, or resigns, or forfeits his office, or is removed from office, the Governor-General may appoint some person to fill the vacancy so created, who shall hold office for the unexpired term of his predecessor and thereafter until his successor is appointed.

  7. The powers of the Board shall not be affected by any vacancy in the membership thereof.

MEETINGS.

  1. The Board shall meet for the despatch of business at such times and places as the Board or Chairman may appoint, and a meeting may be summoned at any time by the Chairman.

  2. The Native Minister may direct a meeting to be convened at any time, and thereupon such meeting shall be held.

  3. (1) At the first meeting after every reappointment of the Board, the Board shall elect one of its members to be Chairman, and such member when so elected shall thereupon preside over the meeting of the Board at which he has been so elected, but he shall not come into office until his election as Chairman of the Board has been approved by the Native Minister.

(2) At every meeting for the election of a Chairman the Secretary of the Board shall preside, and in any case of an equality of votes shall determine the election by lot in such manner as the Board directs.

(3) The Secretary of the Board shall forthwith submit to the Native Minister the name and description of the member elected to be Chairman of the Board.

  1. All questions coming before the Board at any meeting shall be decided by a majority of the votes of the members present thereat.

  2. At every meeting the Chairman, or, in his absence, some other member to be chosen by those present, shall preside, the Chairman or presiding member shall have a deliberative vote, and in case of equality of votes shall have a casting-vote also.

  3. A quorum at any meeting of the Board shall consist of five members, and no business shall be transacted at any meeting unless a quorum is then present.

  4. If within half an hour after the time for which a meeting of the Board has been appointed, whether by summons or by adjournment, a quorum is not present, the member or members present, or, if no member be present, an officer of the Board, may adjourn the meeting to such time and place as is thought fit.

  5. All proceedings and resolutions of the Board shall be recorded in a minute-book to be kept for the purpose. At the end of each and every meeting the Chairman or Secretary of the Board shall supply a copy of or an extract from the minutes of the Board to the Under-Secretary.

SEAL.

  1. The seal of the Board shall be such as is determined by the Board and approved by the Native Minister, and shall be kept in the custody of the Chairman or of such officer of the Board as it may appoint for the purpose.

  2. The seal of the Board shall not be affixed to any document except in the presence of two members of the Board and of the Secretary or other responsible officer of the Board, all of whom shall attest the sealing of the document.

OFFICERS.

  1. (1) The Board may from time to time, with the approval of the Native Minister, appoint some fit and proper person to be the Secretary of the Board, and, with the like approval, may at any time remove any such Secretary and appoint some other fit person in the place of the Secretary so removed.

(2) The Secretary of the Board shall be deemed to be the servant of the Board, and shall receive such salary or other remuneration as the Board, with the approval of the Native Minister, shall determine.

(3) The Secretary shall have all such powers and duties as the Board shall determine, and he shall at all times conform to the direction of the Board in that behalf.

  1. The Board may from time to time appoint such other officers and workmen of the Board as shall be found necessary and expedient for the proper carrying-out of the business of the Board.

Revoking Portion of an Order in Council declaring Public Highways to be Main Highways.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 14th day of January, 1932.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by section three of the Main Highways Act, 1922, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth, from the date of gazetting of this Order in Council, hereby revoke the Order in Council dated the second day of July, one thousand nine hundred and twenty-eight, and published in the New Zealand Gazette, No. 54, of the fifth day of July, one thousand nine hundred and twenty-eight, declaring public highways to be main highways in so far as affects that portion of the Kaukapakapa – Port Albert via Glorit and Tauhoa Main Highway described in the Schedule hereto.

SCHEDULE.

KAUKAPAKAPA – PORT ALBERT VIA GLORIT AND TAUHOA: All that portion of the Kaukapakapa – Port Albert via Glorit and Tauhoa Main Highway, situate in the Waitemata and Rodney Counties, commencing at its junction with the Helensville-Waiwera Main Highway on the northern boundary of Section 12, Block 11, Kaipara Survey District, near Kaukapakapa, and proceeding thence generally in a northerly direction via Glorit, and terminating at its junction with the Tauhoa – Kaipara Flats Main Highway, being a distance of twenty miles, more or less. As the same is more particularly delineated on plan marked P.W.D. 83427, deposited in the office of the Main Highways Board at Wellington, and thereon coloured red.

Revoking the Declaration of Portions of Main Highways and declaring Public Highways to be Main Highways.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 14th day of January, 1932.

Present:

IN pursuance and exercise of the powers and authorities vested in him by section three of the Main Highways Act, 1922, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth, from the date of gazetting of this Order in Council, declare that the portions of main highways described in the First Schedule hereto shall cease to be main highways, and doth further declare that the roads described in the Second Schedule hereto shall be main highways within the meaning and for the purposes of the Main Highways Act, 1922.

FIRST SCHEDULE.

HIGHWAY DISTRICT NO. 2.

TAKAPUNA–SILVERDALE: All that road or portion of road in the Waitemata County, commencing at its junction with Carlyle Road in Block IV, Waitemata Survey District, and proceeding generally in a northerly direction through Block IV, Waitemata Survey District, and Blocks XI, XV, XVI, Waiwera Survey District, and terminating at its junction with the Auckland–Maungaturoto Main Highway at Silverdale, being a distance of 8 miles, more or less. Shown on plan P.W.D. 83109, and thereon coloured green.
