In the matter of the Religious, Charitable, and Educational Trusts Act, 1908, and in the matter of the disposal of the Tower and Bells Fund held by the Churchwardens and Vestry of the Cathedral Parish of St. John the Evangelist, of Napier.

NOTICE is hereby given as follows:—

  1. It being impracticable and inexpedient, for the reasons set out in the Scheme and Petition hereinafter mentioned, to carry out the trusts upon which the above fund is held—namely, for the erection and supply of a Bell Tower and Peal of Bells for the Cathedral at Napier—a scheme has been prepared under the provisions of the above Act, and has been submitted to the Honourable the Attorney-General for New Zealand.

  2. Such scheme provides that portion of the said fund shall be applied in purchasing an Organ from Knox Church, Dunedin, and installing the same in the Pro-Cathedral now erected in Napier, and that the balance thereof after payment thereout of the reasonable costs of preparing the Scheme and incidental thereto shall be held by the Waiapu Board of Diocesan Trustees upon trust to apply the same and the resulting income therefrom in and towards the repair, maintenance, or replacement of the said Organ.

  3. The Honourable the Attorney-General has made his report on the proposed Scheme, wherein he states that in his opinion the Scheme is a proper one for the approval of a Judge of the Supreme Court.

  4. A Petition has been filed in the said Court by Roger Walter Hansard, acting for and on behalf of the Churchwardens and Vestry of the Cathedral Parish of St. John the Evangelist, praying that an Order be made approving of the said Scheme and for an Order as to costs.

  5. The said Scheme and the Report thereon of the Honourable the Attorney-General have been filed in the office of the Registrar at Napier of the Supreme Court of New Zealand, and the same and the said Petition are open to inspection by the public without any fee or charge.

  6. An application will be made to the Right Honourable Sir Michael Myers, Knight, Chief Justice of New Zealand, at Napier, on Monday, the 8th day of August, 1932, at 10.30 o’clock in the forenoon, or so soon thereafter as counsel for the parties concerned can be heard, for an Order in terms of the prayer of the said Petition.

DISSOLUTION OF PARTNERSHIP.

NOTICE is hereby given that the Partnership heretofore subsisting between the late MATTHEW COLLINS WEARNE and FREDERICK MOIR, trading as “Wearne and Moir,” of Lyttelton, Carriers, has been dissolved, as from the 20th day of June, 1932, by the death of the said Matthew Collins Wearne. The said business will hereafter be carried on by the said Frederick Moir alone, who will receive all debts due to the Partnership.
