And whereas it is desirable to revoke the same:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the thirty-first day of August, one thousand nine hundred and thirty-one, as from the thirty-first day of August, one thousand nine hundred and thirty-one.

Setting aside Native Land as a Native Reservation.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 15th day of July, 1932.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

WHEREAS by section two hundred and ninety-eight of the Native Land Act, 1931, it is enacted, inter alia, that when any Native freehold land is owned at law or in equity by more than ten owners in common the Governor-General may, by Order in Council, set apart and reserve any part of that land for the common use of the owners thereof as in the said Act provided:

And whereas the Native Land Court has recommended that the land described in the Schedule hereto be set apart as a Native reservation:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority hereinbefore mentioned, and all other powers thereunto him enabling, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby set apart and reserve the Native freehold land described in the Schedule hereto for the common use of the owners thereof as a meeting-place.


SCHEDULE.

BLOCK II, MAHANGA SURVEY DISTRICT.

ALL that area of land situate in the Tairawhiti Native Land Court District called or known as “Mahanga 1c 1e Block,” containing 7 acres 2 roods, more or less, and being the whole of the land comprised in a partition order of the Native Land Court dated the 27th August, 1914.

The Western Side of Portion of Princes Street, in the Borough of Northcote, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 15th day of July, 1932.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Northcote Borough Council on the twenty-first day of June, one thousand nine hundred and thirty-two, viz.:

“That the Northcote Borough Council, being the local authority having control of the streets in the Borough of Northcote, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Princes Street, Northcote, adjoining Lots 1, 2, 3, and 6, on Land Transfer Plan 23966, being portion of Allotments 30 and 31, Parish of Takapuna, and portion of Allotment 1, Suburbs of Woodside”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Princes Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE.

THE western side of all that portion of street situated in the North Auckland Land District, Borough of Northcote, known as Princes Street, fronting Lots 1, 2, 3, and 6 on Land Transfer Plan 23966, being portion of Allotments 30 and 31, Parish of Takapuna, and portion of Allotment 1, Suburbs of Woodside. As the said portion of street is more particularly delineated on the plan marked P.W.D. 84106, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Eastern Side of Portion of King Street and the Southern Side of Portion of Short Street, in the Borough of Newmarket, exempted from the Provisions of Section 128 of the Public Works Act, 1928.

At the Government Buildings at Wellington, this 15th day of July, 1932.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Newmarket Borough Council on the eighteenth day of May, one thousand nine hundred and thirty-two, the portions of streets affected by such resolution being more particularly described in the Schedule hereto, viz.:

“That the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply to that part of King Street and Short Street in the Borough of Newmarket, being the part of the said King Street fronting Lots 10, 11, 12, and 13, for a distance of 305 links, and part of the said Short Street fronting Lots 13 and 14, for a distance of 202 links.”


SCHEDULE.

THE eastern side of all that portion of street situated in the North Auckland Land District, Borough of Newmarket, known as King Street, fronting Lots 10, 11, 12, and 13, of Section 1 of Allotments 39 and 40, Section 3, Suburbs of Auckland.

Also the southern side of all that portion of street situated in the said land district and borough, known as Short Street, fronting Lots 13 and 14 of Section 1 of Allotments 39 and 40, Section 3, Suburbs of Auckland.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 84105, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Vesting the Control of a Reserve in the Whakatane County Council.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 15th day of July, 1932.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for a resting-place for travelling stock: And whereas it is expedient that the control of the said reserve should be vested in the Whakatane County Council.

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the said reserve in the Whakatane County Council.


SCHEDULE.

AUCKLAND LAND DISTRICT.

LOT 2 of Allotment 98, Rangitaiki Parish: Area, 1 rood 36·4 perches.
