and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Auckland City Council on the fifth
day of November, one thousand nine hundred and thirty-one,
viz. :—
“ The Auckland City Council, being the local authority
having control of the streets in the City of Auckland, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to that portion of Beatrice Road adjoining part of
Allotment 34, Section 14, Suburbs of Auckland ”;
such portion of street being described in the Schedule hereto.

SCHEDULE.
THE south-western side of all that portion of street situated
in the North Auckland Land District, City of Auckland, known
as Beatrice Road, fronting part Allotment 34 of Section 14,
Suburbs of Auckland. As the said portion of street is more
particularly delineated on the plan marked P.W.D. 83202,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

Vesting the Control of a Reserve in the Tikokino War Memorial
Public Library Board.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 20th day
of May, 1932.
Present :
THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.
WHEREAS the lands described in the Schedule hereto
have been permanently reserved for a site for a
public library :
And whereas it is expedient that the control of the said
reserve should be vested in a special Board as hereinafter
provided :
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and *with the advice
and consent of the Executive Council of the said Dominion,
and in exercise of the powers and authorities conferred upon
him by section seventeen of the Public Reserves, Domains,
and National Parks Act, 1928, doth hereby vest the control
of the reserve described in the Schedule hereto, for the period of
five years from the date hereof (unless previously amended
or revoked under the said Act), in the undermentioned persons,
namely,—
Rose Brassington,
Agnes Petrie,
Alice May Brooke,
Hetty White,
Sarah Gertrude Ann Buchanan,
Margaret Helen Ann Buchanan,
Edward Kirby Richardson,
Edward Richardson, junior,
James Petrie,
John Parkinson, and
Frederick Ellmers,
who are hereby constituted for that purpose a special Board
by the name of the Tikokino War Memorial Public Library
Board (hereinafter referred to as “ the Board ”), with the
powers and subject to the conditions hereinafter contained,
that is to say :—

The Board shall meet for the transaction of business
at the Tikokino War Memorial Public Library, or at such other
place and at such time as may be from time to time fixed by the
Board. The first meeting shall be held on Wednesday, the
eighth day of June, one thousand nine hundred and thirty-two. -
The members of the Board shall at their first meeting,
and thereafter at the annual meeting hereinafter mentioned,
elect one of themselves to be Chairman, who may join in the
discussion, and shall have an original as well as a casting
vote. The Chairman shall hold office until the election of
his successor. -
Special meetings may be convened by the Chairman,
provided that two days’ notice of such meeting be given to
each member, specifying the business to be transacted at
such special meeting ; and no other business than that so
specified shall be transacted at such meeting. -
Any six members of the Board shall form a quorum.
Any meeting may be adjourned from time to time. -
If at any meeting the Chairman is not present at the
time appointed for holding the same, the members present
shall choose one of their number to be Chairman of such
meeting. -
If by resignation, death, incapacity, or otherwise the
seat of any member shall be or become vacant, or if any
member absents himself, without reasonable cause, from three
consecutive meetings of the Board, the Governor-General
shall have power to appoint any other person to be a member
of the Board in his (or her) stead. -
All questions shall be determined by the majority of
votes of the members of the Board present at a meeting. -
The Board shall have prepared and submitted at an
annual meeting held in the month of April in each year a
report of the proceedings of the Board for the previous year
ending on the thirty-first day of March, together with a
statement of the receipts and expenditure of the Board for
such year. A copy of every such report and statement,
certified by the Chairman to be correct, shall be sent to
the Minister of Lands as soon as possible after each annual
meeting. -
The Board shall control the said reserve and the building
erected thereon for the purposes of a war memorial public
library, and may afford settlers and residents of Tikokino and
the surrounding district such facilities for meeting within
the said building as may from time to time be determined by
the Board : Provided that the Board shall have power to
fix reasonable charges for the use of the said building.

SCHEDULE.
ALL that area in the Hawke’s Bay Land District, containing by
admeasurement 19·4 perches, more or less, being part Section
175, Township of Hampden (Tikokino), Hawke’s Bay Land
District. Bounded towards the north by Owen Street, 60·6
links ; towards the east by part Section 175, 200 links ;
towards the south by Section 7, 60·6 links ; and towards the
west by Section 86, 200 links : be all the aforesaid linkages
more or less. As the same is delineated on the plan marked
L. and S. 22/2793, deposited in the Head Office, Department
of Lands and Survey, at Wellington, and thereon coloured red.

Otago, in Robert Fraser, Claude Gaudin Martin, Kenneth
Ross, David Morgan, Innis Mackay, William Wells, and
Donald McLeod Little, as Trustees for the Inhabitants of
the Locality.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 20th day of
May, 1932.

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.
WHEREAS it is enacted by section one hundred and
fifty-eight of the Harbours Act, 1923 (hereinafter
called “ the said Act ”), that where the foreshore outside
the limits of a harbour is not vested in any Harbour Board
or other local authority the Governor-General may, by Order
in Council, grant for a period not exceeding twenty-one
years the control of such part or parts thereof as he thinks
fit to any local authority, Domain Board, or persons acting
as trustees for the inhabitants of the locality, upon such
conditions as may be prescribed in the Order :
And whereas the foreshore hereinafter described is not
vested in any Harbour Board or other local authority, and
Robert Fraser and Claude Gaudin Martin, both of Tahakopa,
Kenneth Ross, David Morgan, and Innis Mackay, all three
of Papatowai, William Wells and Donald McLeod Little,
both of Maclennan, as trustees for the inhabitants of the
locality (hereinafter referred to as “ the trustees ”), have
applied to the Governor-General in Council for the control
thereof :
And whereas it is desirable that the control should be
granted to the trustees :
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the power and authority conferred upon him by the said
Act, and acting by and with the advice and consent of the
Executive Council, doth hereby grant to the trustees the
control of the foreshore as described in the First Schedule
hereto, and subject to the terms and conditions set forth in
the Second Schedule hereto.
