Order in Council consenting to the Raising by the Raglan County Council of a Loan of £6,400 on the Instalment-repayment System, and prescribing the Rate of Interest in respect thereof.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of February, 1932.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Raglan County Council (hereinafter called “the said local authority”), has been authorized to borrow in respect of a loan to be known as “The Tuakau Bridge Loan, 1931,” the sum of six thousand four hundred pounds, and the said sum has not yet been borrowed:

And whereas the Minister of Finance has given his precedent consent as required by section one hundred and fourteen of the Local Bodies’ Loans Act, 1926, to the borrowing by the said local authority of the said loan at such rate or rates of interest as shall not produce to the lenders a rate exceeding the rate hereinafter mentioned:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by the Local Government Loans Board Act, 1926, and by sections thirty-two and one hundred and fourteen of the Local Bodies’ Loans Act, 1926, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan up to the amount of six thousand four hundred pounds at such rate or rates of interest as shall not produce to the lenders a rate exceeding the rate of five pounds ten shillings per centum per annum, upon terms of making the said loan, together with interest thereon, repayable by instalments extending over a period of thirty-six and a half years.

Order in Council validating Proceedings in connection with the Otorohanga County Council’s Loan of £180.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of February, 1932.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Otorohanga County Council lately proceeded to raise a loan of one hundred and eighty pounds under the Local Bodies’ Loans Act, 1926 (hereinafter referred to as “the said Act”), for the purpose of re-forming, culverting, and metalling part of Barber’s Road, commencing at the western boundary of Section 6, Block XIV, Mangao-rongo Survey District, and extending southwards:

And whereas the proceedings in connection with the said loan were irregular or defective in that the consent of the ratepayers was not obtained prior to the making of the special order authorizing the raising of the loan, as required by section seventeen of the Local Bodies’ Loans Act, 1926:

And whereas it appears that the ratepayers of the district have not been misled by such irregularity or defect as aforesaid, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and twenty-two of the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings in connection with the said loan shall be valid to all intents and purposes as though the consent of the ratepayers had been obtained prior to the making of the special order authorizing the raising of the loan; and that the validity of the proceedings in connection with the said loan, or the validity of the security for the said loan, shall not be called in question by reason only of the irregularity or defect aforesaid.

And whereas the Minister of Finance has given his precedent consent as required by section one hundred and fourteen of the Local Bodies’ Loans Act, 1926, to the borrowing by the said local authority of the said loan at such rate or rates of interest as shall not produce to the lenders a rate exceeding the rate hereinafter mentioned:

Revoking the Vesting in the Selwyn County Council of Reserves 63 and 63A, Christchurch Survey District, Canterbury Land District.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of February, 1932.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the lands described in the Schedule hereto are reserves vested in the Selwyn County Council, in trust, for the purposes of ferries, by an Order in Council dated the thirtieth day of September, one thousand eight hundred and seventy-nine, and published in the Gazette of the ninth day of October, one thousand eight hundred and seventy-nine, in pursuance of section six of the Public Reserves Act Amendment Act, 1878:

And whereas it is expedient that the said Order in Council should be revoked in so far as concerns the said land, and the Selwyn County Council has duly consented to such revocation:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by subsection one of section ten of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby revoke the Order in Council hereinbefore referred to in so far as concerns the land described in the Schedule hereto.

SCHEDULE.

ALL that area in the Canterbury Land District containing by admeasurement 16 perches, more or less, being Reserve No. 63, Block XVI, Christchurch Survey District.

Also all that area in the Canterbury Land District containing by admeasurement 24 perches, more or less, being Reserve No. 63A, Block XVI, Christchurch Survey District.

As the same are more particularly delineated on the plan marked L. and S. 6/1/500, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
