REGULATION 5.—REGISTRATION.

(1) Every person passing the examination under the said Act and these regulations shall be entitled without payment of any fee to a certificate in the form of the Second Schedule hereto. Such certificate shall be signed by the Chairman and two other members of the Board and shall also be signed by the holder thereof.

(2) The issue of a certificate in the form in the Second Schedule hereto shall not be deemed to entitle any person to registration without payment of the fee prescribed by clause (4) of Regulation 6 hereof.

(3) Every certificate of registration issued pursuant to section 9 of the said Act, or to clause (5) of Regulation 6 hereof, shall be in the form in the Third Schedule hereto. Such certificate shall have stamped or printed on the face thereof, in large figures, the reference to the year in which it was issued, shall be in form suitable for carrying in the pocket, and shall be signed by the holder thereof.

(4) The annual list of registered plumbers referred to in section 11 of the said Act shall be sent to the Minister of Health in the month of February in each year, and shall thereupon be published in the Gazette not later than the twenty-eighth day of that month.

REGULATION 6.—FEES.

(1) The fee for examination or re-examination in both parts taken as a whole shall be £1.

(2) The fee for examination or re-examination in either the written examination or the practical test taken separately shall, except as provided in the next succeeding clause of this regulation, be £1.

(3) The fee for examination (for the first time only and not for re-examination) in the written examination taken separately of an apprentice, if the date fixed for such examination is at least five years and not more than five years and a half after the date of commencement of his apprenticeship, shall be 10s.

(4) The fee for registration under section 8 of the said Act shall in all cases be 5s., such fee to include a certificate of registration in the form in the Third Schedule hereto.

(5) The fee for the annual publication of the name of any registered person in the Gazette pursuant to section 11 of the said Act shall be 5s., and on payment of such fee there shall be issued a certificate of registration in the form in the Third Schedule hereto: Provided that the previous certificate has been returned to the Board, or that it is proved to the satisfaction of the Board that such previous certificate has been lost or destroyed.

(6) The fee for a certificate under the hand of the Director-General of the entry of the name of any person in the Register pursuant to section 12 of the said Act shall be 5s.

REGULATION 7.—DISTRICTS.

(1) The districts or localities within which all sanitary plumbing shall be done by a person registered under the said Act are those set out in the Fourth Schedule hereto.

(2) If any person commits a breach of any by-law made by a local authority relating to sanitary plumbing, it shall be the duty of that local authority (whether or not proceedings are taken in respect of such breach) to give to the Board full particulars of such breach and of the name of the person committing the same.

REGULATION 8.—APPEAL.

(1) In the event of the Board’s refusing to cause the name of any person to be entered in the Register, or of the Board’s removing any person’s name from the Register, the Board shall forthwith inform such person of such refusal or removal, and of the reason for the same if and so far as such reason is expressed in any resolution of the Board.

(2) Any person wishing to appeal under section 14 of the said Act shall give notice of appeal in the form set out in the Fifth Schedule hereto, and shall specify therein the name of the person whom he appoints to act as assessor on his behalf at the hearing of his appeal, and such assessor shall give in writing his consent to act.

(3) Within twenty-one days after receipt of such notice of appeal the Board shall inform the appellant of the name of the Magistrate before whom the appeal will be heard, and of the assessor appointed by the Board, and shall at the same time forward to such Magistrate a copy of the Board’s decision and the notice of appeal therefrom, together with a notice of the appointment of an assessor by the Board.

(4) The Magistrate and assessors shall hear and determine such appeal at such convenient place and time as may be decided by the Magistrate, to be not more than forty-two days from the receipt by the Board of the notice of appeal.

(5) The Magistrate shall cause at least five days’ previous notice of such place and time to be given to each assessor, the Board, and the appellant.

(6) At the hearing of the appeal the appellant may himself appear or may be represented by some other person on his behalf, and the Board may be represented by any member thereof appointed by the Board, or by some other person appointed by the Board; but no solicitor or counsel shall appear or be heard.

(7) The Magistrate may from time to time adjourn the hearing or consideration or determination of the appeal as he thinks fit.

(8) If the appellant or his representative fails to appear at the hearing the appeal may be determined in his absence on such evidence as is available. If he appears the evidence shall be taken in his presence or in the presence of his representative, or both.

(9) The determination made in respect of an appeal shall be in writing signed by the Magistrate and at least one of the assessors, and a copy thereof shall be forwarded by the Magistrate to the appellant and to the Board, and the Board shall forthwith give effect to such determination.
