ballot-paper shall contain the names and addresses of every person nominated and consenting to act, and shall also set forth :—
(i) Directions how to vote;
(ii) The date and hour of the closing of the ballot;
(iii) A direction to transmit the ballot-paper, when completed, to the President of the association.
(d) Forthwith upon the receipt of the ballot-papers as aforesaid, the union shall cause one ballot-paper (together with an envelope addressed as aforesaid) to be delivered to each of its members entitled to vote.
(e) The voter shall strike out the name of every candidate for whom he does not intend to vote by drawing a line through the name with a pen or pencil. If no name is left uncanceled, or if more than one name is left uncanceled, on the said ballot-paper, the ballot-paper shall be deemed to be invalid. The voter shall transmit the ballot-paper when completed to the President of the association.
(f) The President of the association shall convene a meeting thereof to be held as soon as practicable after the closing of the ballot, and the association shall, before or at such meeting, appoint some independent person as returning officer for the purpose of counting the votes. The said votes shall be counted by the returning officer in the presence of such of the members of the association as choose to be present.
(g) The person who receives the largest number of votes at any such ballot shall be deemed to be elected a member of the Board by the association.
(h) If at any ballot under these regulations two or more persons receive an equal number of votes, the returning officer shall, if necessary, decide by lot which of them is to be deemed to be elected a member of the Board.
(i) Forthwith upon the completion of the election the President shall, by writing under his hand, transmit to the Director-General the name, address, and occupation of the person elected.
(j) If only one person be nominated then the ballot shall not be held, and such person shall be deemed to be elected, and the President shall forthwith transmit his name, address, and occupation to the Director-General as aforesaid.
(3) An election under this regulation shall not be deemed to be invalid because of any informality in the proceedings or failure to fully observe the conditions of these regulations, and the notice of the result of the election under the hand of the President shall be conclusive evidence of the validity of such election.
(4) In the event of no nomination being received for any election the President shall certify such event to the Director-General, and the Governor-General may forthwith appoint some person holding the necessary qualification to be a member of the Board, and such person shall hold office for the term of three years prescribed by section 3 of the said Act.
REGULATION 4.—EXAMINATIONS.
(1) The Board shall from time to time, at intervals of not less than three months or more than thirteen months, hold, at such convenient places as the Board may decide, examinations of candidates for registration as plumbers under paragraph (a) of subsection (1) of section 7 of the said Act.
(2) The Board shall, by advertisement in such newspapers published in New Zealand as it thinks fit, give due notice of the dates and places on and at which such examination will be held.
(3) Every candidate must give notice in the form provided by the Board of his intention to present himself for examination, and such notice, accompanied by the fee prescribed in clauses (1) to (3) of Regulation 6 hereof, must be sent so as to reach the Secretary of the Board at least one calendar month before the date of the examination :
Provided that the Board may, if it thinks fit, on payment of the sum of 5s. in addition to the prescribed fee, permit any person who has given the prescribed notice but not so as to reach the Secretary by the time hereinbefore specified to present himself for examination under these regulations.
(4) The subjects to which a candidate shall be examined are those set out in the syllabus in the First Schedule hereto.
(5) The examination shall consist of two parts, namely,—
(a) A written examination, for which not less than three hours shall be allowed; and
(b) A practical test of workmanship.
(6) The material for the practical test shall be supplied by the Board, but each candidate shall provide his own tools.
(7) The examination may be passed in two parts or as a whole; but no candidate shall be allowed to present himself for the written examination until he has served at least five years as an apprentice or has been engaged in the plumbing trade for not less than seven years; nor shall any candidate be allowed to present himself for the practical test until he has served at least five years and a half as an apprentice, or has been engaged in the plumbing trade for not less than seven years. No candidate shall receive credit for having passed the practical test unless at the same or at a previous time he has passed the written examination, or, not having passed, has gained at least two-thirds of the marks required for passing such examination :
Provided that, on special application being made, the Chairman of the Board may, if he thinks fit, permit any person who being otherwise eligible, has reached within one month of completion of the above-mentioned periods of training to present himself for examination.
