Education Act, 1914.—Amended Regulations.

IN pursuance and exercise of the powers conferred upon him by the Education Act, 1914, and of all other powers enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations amending the regulations relating to the maintenance, administration, staffing, and salaries of staffs of the secondary and technical schools combined under section two of the Education Amendment Act, 1924, as amended by section thirty-seven of the Finance Act (No. 2), 1931; and with the like advice and consent doth prescribe that this Order shall come into force on the date of the publication thereof in the Gazette.
REGULATIONS.
THE regulations relating to combined secondary and technical schools made by Order in Council dated 25th September, 1931, and published on page 2883 of the New Zealand Gazette of 1st October, 1931, are hereby amended as follows:—

By adding to the definition of “combined school” the words, “and shall also include the schools named in the Schedule hereto.”

By deleting from clause 2 the words “Part IVE, clauses 84–89 inclusive,” and substituting therefor the words “Part IVE, clauses 85–89 inclusive.”

By inserting after clause 2 the following clause:—
“3. (1) In every combined school there shall be not more than one full-time assistant for each complete twenty-eight pupils on the roll of the school at the 1st day of March:
“Provided that where instructors are employed part time in a combined school each ten half-days of such part-time instruction shall count as the weekly service of one normal full-time assistant.
“(2) Of the equivalent full-time staff of assistant teachers employed in a combined school not more than one-sixth of the total number shall receive net salaries, excluding allowances, in excess of £354 per annum for women and £465 per annum for men, and not more than one-third net salaries, excluding allowances, in excess of £300 for women and £380 for men, the nearest whole number being taken in each case:
“Provided that, except where otherwise prescribed in these regulations, each teacher shall be paid the salary corresponding to his classification unless he be appointed, with the approval of the Director, after this regulation comes into force, to a position in which the maximum salary payable is less than that corresponding to his classification, in which case he shall receive the maximum salary corresponding to the position to which he is appointed. The Director of Education shall, on the coming into force of this regulation, require the governing body of each combined school to submit for his approval its proposals under this clause in respect of the staff of such school, and such proposals shall be subject to revision in his discretion.”

By renumbering clauses 3 and 4 as clauses “4” and “5” respectively.

By inserting after new clause 5 the following clause:—
“6. The tuition fees payable by all pupils other than free-place pupils and scholarship-holders, or pupils of any lower Department, or pupils of evening classes shall be such as the Board shall determine, but shall be not less than £4 per term, reducible to £3 10s. if paid within thirty days of the commencement of the term:
“Provided that in the case of pupils attending part time for not more than eight half-days weekly, the fees may be fixed on a proportionate basis:
“Provided, further, that in the case of evening-class pupils and in the case of pupils attending for special short courses of instruction fees shall be determined in accordance with section 119 of the Education Act, 1914.
“Provided, further, that in the case of the Napier Secondary School such fees may be fixed and charged for 1931 as the Board considered reasonable, having regard to the disorganization of the schools caused by earthquakes in that year, and the Board shall have power to remit the whole or any part of the fees so determined.”
