Regulations under the Hawke’s Bay Earthquake Act, 1931, varying the Purposes of certain Loan and other Moneys.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 15th day of December, 1931.
Present:
THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.
IN exercise of the powers conferred by the Hawke’s Bay Earthquake Act, 1931, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth make the following regulations.

REGULATIONS.
THE Committee of Management for the Borough of Napier whilst such Committee shall be in office, and thereafter the Napier Borough Council, shall have the power to apply the moneys mentioned in the Second Column of the Schedule hereto, which moneys are in the separate accounts mentioned in the First Column of the said Schedule for the purpose of street-widening and the making of new streets and service lanes, including the payment of compensation, costs of formation, and incidental expenses.

Regulations under the Hawke’s Bay Earthquake Act, 1931, validating the Raising of Loans by Local Authorities.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 15th day of December, 1931.
Present:
THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers and authorities conferred on him by section sixty-six of the Hawke’s Bay Earthquake Act, 1931 (hereinafter called “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations.

REGULATIONS.

No proceedings on the part of a local authority within the meaning of section 51 of the said Act to raise a loan under the provisions of the said section 51 shall be deemed invalid, irregular, or defective by reason only of the fact that after the Local Government Loans Board has given its sanction to the loan application, such local authority may, notwithstanding the provisions of section 10 pf the Local Government Loans Board Act, 1926, have taken further steps to raise such loan before the consent of the Governor-General in Council was given thereto pursuant to the provisions of the last-mentioned section 10.

Any resolution, confirmation of resolution, making of a rate, execution of a document, or other Act or proceeding, passed, made, or done for the purpose of, or in connection with, raising any such loan before the consent of the Governor-General in Council was given as aforesaid shall, upon the giving of such consent, be of the same force and validity as if the same had been passed, made, or done after such consent had been given.

The validity of any security for such loan shall not be called in question by reason only of any such irregularity or defect as aforesaid.

These regulations shall apply to all loans proposed to be raised pursuant to section 51 of the said Act where any proceedings in connection therewith have been taken, or are pending, or are in progress at the date of the making of these regulations, and whether any sanction of the Local Government Loans Board or any such consent of the Governor-General in Council is given before or after the making of these regulations.

Revoking the Reservation for Recreation Purposes over certain Land in Town of Miranui, Wellington Land District.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 15th day of December, 1931.
Present:
THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.
WHEREAS a notice of intention to issue an Order in Council declaring that the reservation for recreation purposes over the land described in the Schedule hereto shall be cancelled was published in the Gazette of the twenty-sixth day of March, one thousand nine hundred and thirty-one:
And whereas such notice of intention was duly laid before both Houses of Parliament in accordance with the provisions of subsection two of section seven of the Public Reserves, Domains, and National Parks Act, 1928:
And whereas the Legislative Council and the House of Representatives, by resolutions dated respectively the seventh and the fifth days of November, one thousand nine hundred and thirty-one, approved the proposed revocation as aforesaid:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for recreation purposes over the land described in the Schedule hereto, and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.

SCHEDULE.
ALL that area, situated in the Horowhenua County in the Wellington Land District, containing by admeasurement 1 rood 11·9 perches, more or less, being part of Subdivision 11, Manawatu-Kukutauaki 2c Block, and being also Lot 26, D.P. 8548, Town of Miranui, situated in Block XII, Mount Robinson Survey District. As the same is more particularly delineated on the plan marked L. and S. 25/960A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
