Amending Regulations under the National Provident Fund Act, 1926.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 31st day of October, 1931.

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred upon him by the National Provident Fund Act, 1926, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the consent of the Executive Council of the said Dominion, doth hereby make the following regulations for the purposes of that Act, and doth further declare that the amendment hereby made shall take effect on the first day of November, one thousand nine hundred and thirty-one.

THESE regulations may be cited as the National Provident Fund Regulations Amendment, 1931.

The National Provident Fund Regulations, 1927, are hereby amended by revoking clause (4) of Regulation 6 thereof and substituting the following:—
“(4) For his services in and about the collection of interest or otherwise in respect of such securities the Public Trustee shall be entitled to charge and deduct from interest so collected a fee of £3 15s. per centum in respect of interest on mortgages, £1 5s. per centum in respect of interest on local bodies’ debentures, and 10s. per centum in respect of interest on Government securities.”

Licensing the Wilsons (N.Z.) Portland Cement, Limited, to use and Occupy a Part of the Foreshore of Whangarei Harbour as a Site for a Wharf Extension.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 31st day of October, 1931.

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.
WHEREAS by Order in Council dated the twenty-sixth day of April, one thousand nine hundred and twenty-seven, and published in the Gazette of the fifth day of the following month, at page 1371, the Wilsons (N.Z.) Portland Cement, Limited (hereinafter called “the company,” in which term is to be construed, unless the context requires a different construction, its successors and assigns), was licensed to occupy a part of the foreshore and land below low-water mark in Whangarei Harbour as a site for a wharf:
And whereas the company has applied to occupy a further portion of such tidal land and tidal waters required for the extension of such wharf:
And it is desirable that the company should be licensed to use and occupy such further portion of such tidal land and tidal waters as aforesaid:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby license and permit the said company to use and occupy such portions of the tidal land and tidal waters of Whangarei Harbour required for the extension of the said wharf as shown on plan marked M.D. 7004 (three sheets), and deposited in the office of the Marine Department at Wellington.
This license shall be subject to the conditions of the hereinbefore-recited Order in Council of the twenty-sixth day of April, one thousand nine hundred and twenty-seven, and in consideration of the concessions and privileges granted by this Order in Council the company, on being supplied with a copy thereof, shall pay to the Minister the sum of two pounds ten shillings, together with the proportionate part of £1 payable from the date hereof, until the 31st March following, and thereafter, an annual sum of eight pounds instead of seven pounds provided for in the said Order in Council of the twenty-sixth day of April, one thousand nine hundred and twenty-seven.

Licensing the Hobson County Council to Use and Occupy Part of the Foreshore and Land below Low-water Mark at Mapuna, Northern Wairoa River, as a Site for a Metal Landing.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 31st day of October, 1931.

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.
WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned, the Hobson County Council (hereinafter called “the Council,” in which term is to be construed, unless the context requires a different construction, its successors or assigns) has applied to the Governor-General in Council for a license under the Harbours Act, 1923 (hereinafter called “the said Act”), to occupy a part of the foreshore and land below low-water mark at Mapuna, Northern Wairoa River, in order to erect and maintain thereon a metal landing, in accordance with plan marked M.D. 6992, and deposited in the office of the Marine Department at Wellington:
And whereas it has been made to appear to the Governor-General in Council that the work will not be or tend to the injury of navigation, and the said plan has, prior to the making of this Order in Council, been approved by the Governor-General in Council:
And whereas it is desirable that a license should be granted and issued to the Council under the said Act for the purpose aforesaid, on the terms and conditions hereinafter expressed:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the purpose or object for which the said license is required by the Council as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the Council to use and occupy that part of the foreshore and land below low-water mark which is particularly shown and delineated on plan M.D. 6992, so deposited as aforesaid, for the purpose of erecting and maintaining thereon the said metal landing to be erected in accordance with the said plan, such license to be held and enjoyed by the Council upon and subject to the terms and conditions set forth in the Schedule hereto.
SCHEDULE.
CONDITIONS OF MANAGEMENT.
- In these conditions the terms—
“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides:
“Low-water mark” means low-water mark at ordinary spring tides:
“Minister” means the Minister of Marine as defined by the Shipping and Seamen Act, 1908, and includes any officer, person, or authority acting by or under the direction of such Minister.

The concessions and privileges conferred by this Order in Council shall extend and apply to the part of the foreshore and land below low-water mark adjacent thereto necessary for the erection and maintenance of the said metal landing, at the site shown on the plan marked M.D. 6992.

In consideration of the concessions and privileges granted by this Order in Council, the Council shall pay to the Minister, in respect of the site for the metal landing, an annual rental of 1s., payable on demand, such rental to date from the date of this Order in Council.

All persons shall, at all reasonable times, and upon payment of the proper dues, have free and full liberty to use the above-mentioned metal landing, and all rights of ingress and egress thereto and therefrom.

His Majesty or the Governor-General, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress into, over, and out of the said metal landing without payment.

The Council shall maintain and keep the above-mentioned metal landing and all erections on or in connection with the metal landing in good order and repair; and shall at all times exhibit therefrom, and maintain at the Council’s own
