  1. The rights, powers, and privileges conferred by this Order in Council shall continue in force for fourteen years, computed from the 3rd day of April, 1930, unless, in the meantime, such rights, powers, and privileges shall be altered, modified, or revoked by competent authority; and the company shall not assign, charge, or part with any such right, power, or privilege without the previous written consent of the Minister first obtained.

  2. The rights, powers, and privileges conferred under and by virtue of this Order in Council may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the company three calendar months' previous notice in writing. Any such notice shall be sufficient, if given by the Minister, and delivered at or posted to the last known address of the company in New Zealand.

  3. In case the company shall—
    (1) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them;
    (2) Cease to use or occupy the said wharf for a period of thirty days;
    (3) Fail to pay the sums specified in clause 3 of these conditions; or
    (4) Be in any manner wound up or dissolved;
    then, and in any of the said cases, this Order in Council, and every right, power, or privilege, may be revoked and determined by the Governor-General in Council, without any notice to the company or any other proceeding whatsoever; and publication in the Gazette of an Order in Council containing such revocation shall be sufficient notice to the company and to all persons concerned or interested that this Order in Council, and the license, rights, and privileges thereby conferred, have been revoked and determined.

  4. The company shall be liable for any injury which may be caused at the said wharf to any vessel or boat through any default or neglect on the part of the company.

  5. In the event of this Order in Council being revoked for any reason whatsoever, or upon the expiry of the period for which the license is granted, the company shall, if required so to do, remove the said wharf entirely from the site, and restore the site to its original condition within three months from the date of the revocation or expiry, as the case may be; and if the company fails so to do the Minister may cause the said wharf to be removed and the site so restored, and may recover the costs incurred by the said removal and restoration from the company.

Order in Council prescribing the term in respect of the Wanganui City Council's Loan of £54,570.

ORDER IN COUNCIL.

At the Government House at Wellington, this 3rd day of August, 1931.

Present:

His Excellency the Governor-General in Council.

WHEREAS the Wanganui City Council (hereinafter called “the said local authority”) has been authorized to borrow in respect of a loan to be known as “General Purposes and Tramways Repayment Loan, 1931,” the sum of fifty-four thousand five hundred and seventy pounds, and the said sum has not yet been borrowed:

And whereas the Minister of Finance has given his precedent consent as required by section one hundred and fourteen of the Local Bodies' Loans Act, 1926 (hereinafter called “the said section”), to the borrowing by the said local authority of the said sum of fifty-four thousand five hundred and seventy pounds, for the term hereinafter mentioned:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by the said section and by section eleven of the Local Government Loans Board Act, 1926, and of all other powers and authorities enabling him in this behalf, doth hereby prescribe that the said sum of fifty-four thousand five hundred and seventy pounds, or any part thereof, may be raised in respect of the said loan by the said local authority for a term of five years, and the said local authority is hereby authorized to borrow the said sum accordingly.

Prohibiting all Alienation of certain Native Lands other than Alienation in favour of the Crown.

ORDER IN COUNCIL.

At the Government House at Wellington, this 3rd day of August, 1931.

Present:

His Excellency the Governor-General in Council.

ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prohibit for the period of one year from the date of this Order in Council all alienations of the Native lands specified in the Schedule hereto other than alienations in favour of the Crown.

Revoking the License authorizing the Patea Borough Council to use Water from the Mangaroa Stream for the Purpose of generating Electricity.

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, the Electrical Supply Regulations, 1927, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and with the consent of the Patea Borough Council, doth hereby revoke the Order in Council dated the twenty-third day of August, one thousand nine hundred and twenty, authorizing the Patea Borough Council to use water from the Mangaroa Stream for the purpose of generating electricity.
